City of Sunny Isles Beach, FL - RFQ 12-04-04 Dispute Disclosure Limiting our response to claims within its South Region arising out of the performance of professional services, and excluding claims such as those arising out of the use or operation of motor vehicles and the employer/employee relationship, AECOM Technical Services, Inc. responds as follows: As with any large architectural, engineering, and related services company, AECOM Technical Services, Inc. ("AECOM") is, from time to time, involved in claims and litigation, many of which involve third party personal injury and property damage claims. Nonetheless, based upon our current knowledge and belief, there are no such matters in litigation in which AECOM is adverse to City of Sunny Isles Beach, FL, nor any outstanding final judgments against AECOM. AECOM has, however, been involved in the disclosed litigation related to the performance of professional engineering, design, and construction services in its South Region during the past five years. This list of claims excludes (i) subsidiaries of AECOM and (ii) claims involving personal injury and property damage claims not otherwise connected with the claims identified below. Over the past five years, AECOM has been involved in multiple mergers, asset purchases, etc. The following litigation history reflects the experience of these companies from the time that the respective assets were acquired by AECOM or the companies came under ownership and control of AECOM unless otherwise stated. Limiting this response to claims within its U.S. South Region arising out of the performance of professional services, and excluding claims such as those arising out of the use or operation of motor vehicles and the employer/employee relationship, during the past five years, AECOM Technical Services, Inc. (f/k/a Earth Tech, Inc.) has been involved in the following litigation. Florida Department of Transportation v. Earth Tech Consulting, Inc., Case No. 08-CA- 002231 Filed November 13, 2008 Settled December 2010 Claim alleging errors and omissions relative to a salt water intrusion problem arising out of a marsh restoration project. Tipperary Sales d/b/a/ La-Z-Boy Furniture Gallery v. SCDOT, Case No. CA 201 0-CP-1 0-2921 Filed April8, 2008, South Carolina, Court of Common Pleas Pending Complaint for damages sustained to property due to multiple flood ing events from storm water runoff. Persky v. Asphalt Contractors, Inc., Case No. CV-05-1406 Filed June 3, 2005, Montgomery County Alabama Circuit Court Settled December 2009 Wrongful death action alleging negligent performance of road construction work.
