q1 <br />HISTORIC PRESERVATION BOARD RESOLUTION NO. 2008- D `7 <br />A RESOLUTION OF THE HISTORIC PRESERVATION <br />BOARD OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, <br />EXPRESSING SUPPORT FOR THE CITY'S EFFORTS TO <br />ENTER INTO SEPARATE LEASE AGREEMENTS WITH THE <br />STATE OF FLORIDA AND FIVE SEAS INVESTORS, INC. IN <br />ORDER TO REPAIR, RECONSTRUCT AND OPERATE THE <br />NEWPORT FISHING PIER; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, the property known as the Newport Fishing Pier (the "Pier ") located at <br />16701 Collins Avenue was originally built in 1936 and has long been a major attraction for local <br />residents and tourists, attracting over one million visitors; and <br />WHEREAS, the Pier was designated as a historic site by the Miami -Dade County <br />Historic Preservation Board on January 21, 1982, and re- designated as a historic site by the <br />Sunny Isles Beach Historic Preservation Board on June 6, 2005, and by the City Commission on <br />July 14, 2005, and <br />WHEREAS, the Pier was previously operated by Newport Operating Corporation <br />( "Newport") from 1984 through April 23, 2007, via a submerged lands lease with the State of <br />Florida; and <br />WHEREAS, Newport did not renew its lease agreement with the State of Florida and <br />has asked the City to take over the operation of the Pier; and <br />WHEREAS, the Pier experienced major structural damage during Hurricane Wilma in <br />2005, and has been closed to the public due to unsafe conditions; and <br />WHEREAS, the City recently entered into a public private partnership with Newport to <br />allocate funds to redesign, rebuild and eventually reopen the Pier for the public; and <br />WHEREAS, the City Commission has expressed a desire to enter into separate lease <br />agreements with the State of Florida and Five Seas Investors in order to operate the Pier for <br />recreational and educational public purposes; and <br />WHEREAS, the Historic Preservation Board of the City of Sunny Isles Beach, Florida, <br />expresses its support for the City's efforts to enter into lease agreement with the State of Florida <br />and Five Seas Investors, Inc., so that the City can once again have a functioning Pier. <br />NOW THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION <br />BOARD OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Incorporation of Recitals.
