HPB RESOLUTION NO. 2007 - D6 <br />A RESOLUTION OF THE HISTORIC PRESERVATION <br />BOARD OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, <br />APPROVING THE APPLICATION FOR CERTIFICATE OF <br />APPROPRIATENESS REQUESTED BY PETITIONERS <br />GEORGE H. SCHOLL AND DIONE DEL MONICO TO <br />DEMOLISH AND REMOVE THE PROPERTY DESIGNATED <br />AS PERGOLA ATTACHED HERETO AS EXHIBIT "A" <br />LOCATED AT 334 ATLANTIC AVENUE, SUNNY ISLES <br />BEACH, FLORIDA; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, pursuant to Section 171 -3.D., Code of the City of Sunny Isles Beach, <br />Florida, the Historic Preservation Board has been empowered to approve special certificates of <br />appropriateness authorizing the demolition, removal, reconstruction, alteration or new <br />construction of an individual site or in a district which requires determination by the Historic <br />Preservation Board before said certificate can be issued; and <br />WHEREAS, Section 171 -10 of the City of Sunny Isles Beach Code provides, in relevant <br />part, that the Historic Preservation Board's decision on the application for a certificate of <br />appropriateness be based upon an evaluation of the compatibility of the physical alteration or <br />improvement with surrounding properties; and <br />WHEREAS, the property designated as Pergola, located on Atlantic Island, at 334 <br />Atlantic Avenue, Sunny Isles Beach, Florida, folio number 01 -2214- 003 -1360, legally described <br />in Plat Book 34, Page 17, Tract marked Pergola Landing laying west of Lot 71, was designated <br />by the Miami -Dade County Historic Preservation Board as a historic site on January 19, 1984, <br />and re- designated by the Sunny Isles Beach Histcric Preservation Board as a historic site on June <br />6, 2005; and <br />WHEREAS, Pergola sustained major damage during Hurricane Wilma, rendering said <br />structure uninsurable <br />WHEREAS, the Building Department of the City of Sunny Isles Beach has <br />recommended that Pergola be demolished; and <br />WHEREAS, the Petitioners George 14. Scholl and Dione Del Monico, applied for a <br />Certificate of Appropriateness on April 30, 2007, requesting demolition of the remains of <br />Pergola, with removal of said property by a construction dumpster; and <br />NOW THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION <br />BOARD OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Acceptance of Petitioners' Application for Certificate of Appropriateness The <br />Historic Preservation Board hereby approves the Petitioners', George H.
