RESOLUTION NO. 2012 -. I q L( <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST <br />AMENDMENT TO AGREEMENT WITH BEISWENGER, HOCH <br />AND ASSOCIATES, INC. (BH &A), TO PROVIDE POST DESIGN <br />SERVICES FOR THE SUNNY ISLES BEACH/NEWPORT <br />FISHING PIER, IN AN AMOUNT NOT TO EXCEED ELEVEN <br />THOUSAND THREE HUNDRED THIRTY -SEVEN DOLLARS <br />AND FIFTY CENTS ($11,337.50), ATTACHED HERETO AS <br />EXHIBIT "A "; AUTHORIZING THE PAYMENT OF TEN <br />THOUSAND DOLLARS ($10,000.00) AS THE CITY'S <br />CONTRIBUTION FOR REVISION TO PLANS FOR <br />RESTAURANT AREA; AUTHORIZING THE MAYOR TO <br />EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY <br />MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Commission had long desired to reconstruct the historic Fishing <br />Pier at Pier Park for the health, welfare, safety and enjoyment of our residents and tourists alike; <br />and <br />WHEREAS, on March 17, 2011 via Resolution No. 2011 -1693, the City Commission <br />ratified an Agreement with Beiswenger, Hoch and Associates to provide post design services for <br />the Sunny Isles Beach Pier a/k/a Newport Fishing Pier located at 16701 Collins Avenue, in a total <br />amount not to exceed Forty -One Thousand Dollars ($41,000.00); and <br />WHEREAS, since the original design for the Newport Pier Reconstruction was <br />completed, several changes have been made to the design which were required by the permitting <br />agencies as a condition of their approval; and <br />WHEREAS, the City in coordination with Dr. Cornfeld requested modifications to the <br />current design of the restaurant at the Sunny Isles Beach/Newport Fishing Pier; and <br />WHEREAS, Beiswenger, Hoch and Associates has expressed their ability and desire to <br />provide these services subject to the terms and conditions contained within the First Amendment <br />to Agreement, and submitted a proposal to provide these services for the Sunny Isles <br />Beach/Newport Pier Project; and <br />WHEREAS, the City wishes to approve the First Amendment to Agreement with <br />Beiswenger, Hoch and Associates to provide these services for the Sunny Isles Beach/Newport <br />Fishing Pier, in an amount not to exceed Eleven Thousand Three Hundred Thirty -Seven Dollars <br />and Fifty Cents ($11,337.50), attached hereto as Exhibit "A ", bringing the total amount not to <br />exceed to Fifty -Two Thousand Three Hundred Thirty -Seven Dollars and Fifty Cents <br />($52,337.50); and <br />WHEREAS, those design changes were made under a separate contract between BHA <br />and Dr. Cornfeld in an amount of Forty Thousand Three Hundred Forty -Eight Dollars and Eighty <br />Three Cents ($40,348.83), of which the City is Committed to 25% of the cost or in an amount not <br />to exceed Ten Thousand Dollars ($10,000.00), with Dr. Cornfeld contributing 75% of the cost of <br />82012- BHA I" Amendment to Agmt Pier Page 1 of 3 <br />
