RESOLUTION NO. 12 -Z - 71 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ( "CITY ") APPROVING A REQUEST <br />TO MODIFY AN APPROVED SITE PLAN FILED BY 18555 <br />DEVELOPERS, LLC A/K/A GH CO REALTY, LC (THE "APPLICANT") <br />SUBJECT TO CERTAIN CONDITIONS FOR THE PROPERTY LOCATED <br />AT 18555 COLLINS AVENUE; PROVIDING THE CITY MANAGER <br />WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />I. RECITALS <br />WHEREAS, 18555 Developers, LLC a/k/a Gilco Realty, LC (the "Applicant ") applied for a <br />modification to an approved site plan pursuant to Resolution No. 11 -Z -123 passed and adopted by <br />the City Commission of the City of Sunny Isles Beach on November 17, 2011, requesting the <br />following: <br />Pursuant to Section 265- 35(D)(9) of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting approval to increase Floor Area Ratio from <br />500,039 square feet to 543,887 square feet. <br />2. Pursuant to Section 265 -23 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting to transfer 15,000 square feet of development <br />rights and seven (7) units as part of the modified site plan. An adjustment to be made for <br />a decrease of 15,000 square feet and seven (7) units from the City's Transfer of <br />Development Rights Bank or TDR bank accounts designated for private owners. <br />LEGAL: All of Tract "L" less the south 200 feet thereof and less the north 100 feet thereof, of <br />AMENDED Plat of North Biscayne Beach, PB 44 Page 42 <br />ADDRESS: 18555 Collins Avenue <br />WHEREAS, the public hearing of the City Commission was advertised and held as required <br />by law, all interested parties concerned in the matter were heard, and due and proper consideration <br />was given to the matter and to the positive recommendation contained in the City's Community <br />Development Department Review Report; and <br />WHEREAS, notice was provided to all interested parties regarding the Application; and <br />WHEREAS, on May 10, 2012, the City Commission conducted a public hearing on the <br />Application; and <br />12 -7 -- 18555 Collins Avenue <br />
