RESOLUTION NO. 2012 - ►928 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE ORDER <br />NO.5 TO AGREEMENT WITH SHORELINE FOUNDATION, INC. <br />FOR THE NEWPORT FISHING PIER DEMOLITION AND <br />CONSTRUCTION PROJECT, INCREASING THE AGREEMENT BY <br />THIRTY -SEVEN THOUSAND SIX HUNDRED FIVE DOLLARS <br />($37,605.00) FOR REMOBILIZATION, ATTACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO ALL <br />THINGS NECESSARY TO EFFECTUATE THIS RESOLUION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, on September 16, 2010 via Resolution No. 2010 -1605, the City Commission <br />approved an Agreement with Shoreline Foundation, Inc. to provide professional construction <br />services for the demolition and construction of the Historic Sunny Isles Beach/Newport Fishing Pier <br />at Pier Park, in an amount not to exceed Three Million Seven Hundred Seventy -Seven Thousand <br />Eight Hundred Sixty -Six Dollars ($3,777,866.00); and <br />WHEREAS, with the approval of Change Order Numbers 1 -4 with Shoreline Foundation, <br />Inc., decreasing the Agreement amount by Eight Hundred Eighteen Thousand One Hundred Fifty- <br />Eight Dollars and Seventy -Nine Cents ($818,158.79), bringing the total Agreement amount not to <br />exceed to Two Million Nine Hundred Fifty -Nine Thousand Seven Hundred Seven Dollars and <br />Twenty -One Cents ($2,959,707.21); and <br />WHEREAS, due to time constraints, the City instructed Shoreline Foundation, Inc. to start <br />construction of the Newport Pier Project prior to obtaining all permits, the project was halted, and <br />Shoreline Foundation, Inc. demobilized; and <br />WHEREAS, upon obtaining the necessary permits to resume work, Shoreline remobilized to <br />continue the project; and <br />WHEREAS, the remobilization costs were not considered in the original contract and is <br />resulting in Change Order No. 5 in an amount of Thirty -Seven Thousand Six Hundred Five Dollars <br />($37,605.00); and <br />WHEREAS, the City wishes to approve Change Order No. 5 with Shoreline Foundation, <br />Inc., increasing the Agreement in an amount not to exceed Thirty-Seven Thousand Six Hundred Five <br />Dollars ($37,605.00), attached hereto as Exhibit "A ", bringing the total amount not to exceed to Two <br />Million Nine Hundred Ninety -Seven Thousand Three Hundred Twelve Dollars and Twenty -One <br />Cents ($2,997,312.21). <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />82012- Shoreline CO 5 Pier Page 1 of 2 <br />
