Summary Minutes: Special City Commission Meeting January 27, 2009 Sunny Isles Beach, Florida <br />back and withdraw this application and go back to the original one. He also noted one of the <br />requirements of every new building is Art in Public Places, and this is a new building, and to <br />meet City Code, you will have to come up with an Art in Public Places or a donation. <br />Arnold Shevlin, representing the Applicant, reported and presented renderings of the building. <br />Commissioner Goodman asked about the monument sign and noted there are two monument <br />signs at that shopping center now, and Mr. Shevlin said that this is a separate parcel from the <br />shopping center. <br />Vice Mayor Thaler asked about adding an additional handicapped parking space, and Mr. <br />Shevlin said staff recommended for safety purposes and accessibility coming off from Collins <br />Avenue to eliminate one of the two spaces and add landscaping. He noted that there is a <br />handicapped parking space in front of East Coast Jewelers just to the south, as well as at <br />Einstein Bagels, and so within 50 -feet of each building you have three (3) spaces. He also <br />noted that there is going to be a pedestrian walkway from the shopping center to this parcel. <br />Mr. Solera said Section 104- 4.4(A)(2) of the Code requires in lieu of a work of art, the <br />Applicant may pay into the Public Art Trust Fund 1 % of the estimated construction costs, not <br />to exceed $500,000. Mr. Shevlin said the construction of the building is estimated at <br />$500,000, and Mayor Edelcup said then that the donation is $5,000. Mr. Shevlin asked if they <br />can pay the $5,000 upon the issuance of the Building Permit and it was the consensus of the <br />Commission to approve that. <br />Commissioner Brezin moved and Vice Mayor Thaler seconded a motion for approval, <br />subject to staff conditions, and to the additional condition of $5,000 for Art in Public <br />Places. Resolution No. 09 -Z -116 was adopted by a roll call vote of 4-0-1 (Commissioner <br />Scholl absent) in favor. <br />Vote: Commissioner Brezin�es <br />Commissioner Goodman <br />yes <br />Commissioner Scholl <br />absent <br />Vice Mayor Thaler <br />yes <br />Mayor Edelcup <br />yes <br />Mr. Katz said he had previously requested staff to move the sign on the Raanan and Phyllis <br />Katz Sports Center and it has not been done as of yet, and Assistant City Manager Jorge Vera <br />said he will take care of it. <br />Mr. Katz complained about the traffic lights, specifically on Raanan Katz Boulevard where <br />you cannot turn north, and also to open the gate to North Bay Road. From where they live in <br />Oceania IV and V, when you get to Atlantic Boulevard, the green arrow to turn north is about <br />3- seconds long. Something needs to be done to make that light longer, and also at 178" to <br />turn into City Hall. Mayor Edelcup said seven (7) cars can go on a green arrow at 178th <br />Street, and he knows the one by Oceania is very short as well as the one by Atlantic Isle for <br />the u -turn. He said all we can do is to ask FDOT if they will do something about it as it is <br />out of the City's control but we will promote it along with Mr. Katz that it should be longer. <br />2 <br />
