CITY OF SUNNY ISLES BEACH <br />O <br />NOTICE OF ZONING HEARING <br />NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Commission of the <br />City of Sunny Isles Beach, Florida, in the David P. Samson Commission Chambers, Sunny Isles <br />Beach Government Center, 18070 Collins Avenue, Sunny Isles Beach, Florida on Thursday, <br />September 20 at 6:30 p.m., to consider the following Zoning application: <br />Application: 400 Sunny Isles Beach Marina <br />Location: 400 Sunny Isles Boulevard <br />Public Hearing #: Z2012 -11 <br />Summary: <br />The Applicant is requesting approval for a site plan for the property located at 400 Sunny <br />Isles Boulevard. The Applicant is proposing a development consisting of two twenty -story towers <br />which contained 230 condominium units. Additionally, the Applicant is proposing an enclosed <br />commercial marina as a component of the project, and requesting approval to utilize 83,490 square <br />feet and 46 units of Transfer Development Rights (TDRs) which are privately owned by the <br />Applicant. This Application was approved previously by the City Commission but the approval had <br />expired. <br />Requests: <br />1. Pursuant to Section 265 -18 of the City of Sunny Isles Beach Land Development Regulations, <br />the Applicant is requesting site plan approval for two residential towers which contained a <br />combined 230 units and with a total of 448,939 square feet. <br />2. Pursuant to Section 265 -23 of the City of Sunny Isles Beach Land Development Regulations, <br />the Applicant is requesting approval to utilize TDRs from the Applicant privately owned TDR <br />Bank in the amount of 83,490 square feet of development rights and 46 dwelling units for the <br />two residential towers. <br />3. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development Regulations, <br />the Applicant is requesting a variance to permit a pedestal to tower front setback to be 22' -6 ", <br />where a minimum of 25' -0" is allowed in accordance with Section 265 -38 (Summary Chart <br />B) of the Land Development Regulations. <br />4. Pursuant to Section 265 -15 of the City of Sunny Isles Beach Land Development Regulations, <br />the Applicant is requesting a variance to permit a pedestal to tower side setback to be 0' -0 ", <br />where a minimum of 25' -0" is allowed in accordance with Section 265 -38 (Summary Chart <br />B) of the Land Development Regulations. <br />5. Pursuant to Section 265 -13 of the City of Sunny Isles Beach Land Development Regulations, <br />the Applicant is requesting a conditional use to permit an enclosed commercial marina. <br />6.
