No other marine type of uses shall be permitted on site except the boat storage use. <br />6. That in the event of multiple ownership, a homeowner's association be established in <br />accordance with applicable regulations to assure that all common areas and facilities for <br />the residents, as well as all easements dedicated to the City, shall be maintained in <br />continuous and satisfactory manner and without expense to the general taxpayers of the <br />City of Sunny Isles Beach. <br />7. That the Applicant shall design and construct a decorative landscape facade with a picket <br />fence around the Sewage Pump Station located on Sunny Isles Boulevard subject to the <br />approval of the City Manager or designee and Miami -Dade County Water and Sewer <br />Department ( "Miami- Dade "). The Applicant shall also demolish an existing above <br />ground water tank that is no longer in used by Miami -Dade. The Applicant shall provide <br />the City and Miami -Dade with all design plans before proceeding with construction of <br />the landscape facade and demolishing of the water tank. If Applicant fails to construct <br />the facade and demolish the water tank within two (2) years of approval of this <br />application by the City Commission, the Applicant shall provide the City with a monetary <br />contribution of One Hundred Fifty Thousand ($150,000) for the design and construction <br />of the facade. <br />8. That the Applicant complies with all conditions and permit requirements, established by <br />Miami -Dade County and Resolution 06 -SDRC -001, adopted on November 27, 2006, by <br />the Shoreline Development Review Committee. Additionally, the Applicant shall comply <br />with the requirements of the Fire and Water and Sewer Departments, Florida Department <br />of Environmental Protection (DEP) and Florida Department of Transportation (FDOT). <br />10. No building permits shall be issued (except for demolition and sales trailers) unless the <br />Applicant has submitted all documents referred to under this approval and shall have paid <br />all impact fees, bonuses, and Transfer of Development Rights (if applicable), professional <br />fees (as per Section 267 -5 of the City Code and such other applicable Land Development <br />Regulations) due to the City. <br />11. That the Applicant shall pay all fees related to the review of the application described <br />herein and shall have paid all other fees due to the City. <br />12. That the Applicant must submit a separate building permit prior any installation of murals <br />or graphics on temporary construction fencing to be approved administratively by the <br />City Manager or designee. <br />400 Sunny Isles Beach Marina Page 5 of 9 <br />
