RESOLUTION NO. 2017- Z(0151" <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, EXPRESSING SUPPORT FOR <br /> SENATE BILL 1682 WHICH WOULD PROHIBIT CERTAIN <br /> CONDUCT BY WAYWARD CONDOMINIUM BOARD MEMBERS <br /> AND PROVIDING FOR CRIMINAL PENALTIES, AMONG <br /> OTHER REQUIREMENTS; URGING THE FLORIDA <br /> LEGISLATURE TO ADOPT THE LEGISLATION AND <br /> GOVERNOR RICK SCOTT TO SUPPORT AND APPROVE THE <br /> LEGISLATION; DIRECTING THE CITY CLERK TO <br /> DISTRIBUTE COPIES OF THIS RESOLUTION; PROVIDING <br /> FOR AN EFFECTIVE DATE. <br /> WHEREAS, Senator Rene Garcia has filed Senate Bill 1682 for consideration by the <br /> Florida Legislature, which would amend Chapter 718 of the Florida Statutes to prohibit certain <br /> conduct by wayward members of condominium boards and providing for criminal penalties,among <br /> other requirements; and <br /> WHEREAS, these proposed revisions to Chapter 718 of the Florida Statutes would greatly <br /> assist in protecting condominium unit owners by imposing tightened conflict of interest <br /> restrictions, requiring full disclosure and greater recordkeeping requirements, clarifying board <br /> membership and election requirements and imposing criminal penalties against wayward board <br /> members; and <br /> WHEREAS, legislative reform is sorely needed in the area of condominium law given the <br /> many reported cases of abuse by certain wayward condominium board members throughout the <br /> state of Florida; and <br /> WHEREAS, the proposed tightened restrictions, full disclosure requirements and <br /> imposition of criminal penalties against wayward board members is the only effective deterrent for <br /> board member misconduct; and <br /> WHEREAS, it is in the best interests of the public and condominiums throughout the state <br /> of Florida that the Florida Legislature adopt the proposed Senate Bill 1682. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1.
