RESOLUTION NO. 2012 - IRS <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, APPROVING CHANGE ORDER NO. 3 TO <br />AGREEMENT WITH TENEX ENTERPRISES, INC. FOR CONSTRUCTION <br />OF A NEW DRIVEWAY ACCESS ON THE WEST SIDE OF COLLINS <br />AVENUE, SOUTH OF 183RD STREET, IN AN AMOUNT NOT TO EXCEED <br />FIFTY -EIGHT THOUSAND THREE HUNDRED THIRTY -ONE DOLLARS <br />AND TWENTY -ONE CENTS ($58,331.21), ATTACHED HERETO AS <br />EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO DO ALL <br />THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, on January 19th, 2012 the City Commission approved Resolution No. 2012- <br />1834, awarding RFP No. 11 -11 -03 and authorized the City Manager and City Attorney to enter into <br />an agreement with Tenex Enterprises, Inc. to provide services on a unit price basis for the Collins <br />Avenue Sidewalk Pavers Project, in an amount not to exceed Five Hundred Forty-Six Thousand One <br />Hundred Sixty -One Dollars and Fifty -Cents ($546,161.50), attached hereto as Exhibit "A "; and <br />WHEREAS, on March 1, 2012 via Resolution No. 2012 -1862 the City Commission <br />approved the optional landscaping component to RFP No. 11- 11 -03, to expand the scope of the <br />Collins Avenue (west side) Sidewalk Pavers Project to include enhanced landscaping and fiber optic <br />projects by amending Resolution No. 2012 -1834 increasing the amount from $750,000.00 to <br />$990,000.00; and <br />WHEREAS, on June 21, 2012 via Resolution No. 2012 -1921 the City Commission approved <br />the Second Amendment to an Agreement with Tenex Enterprises, Inc., to add landscaping <br />improvements to Intracoastal Parks, irrigation and electrical work related to the tree up- lights, and for <br />the installation of a meandering walkway in the Parks, in an amount not to exceed Three Hundred <br />Seventy -Two Thousand One Hundred Fifty -Seven Dollars and Thirty-Six Cents ($372,157.36); and <br />WHEREAS, the City wished to have the walkway in the Intracoastal Parks constructed in <br />concrete, with in -house crews performing the form work, and on September 21, 2012 via Resolution <br />No. 2012 -1960 the City Commission rescinded Resolution No. 2012 -1921 and approved Change <br />Order No. 2 for landscape and lighting improvements directly abutting Collins Avenue in an amount <br />not to exceed Two Hundred Eighty Thousand Three Hundred Ninety Dollars and Thirteen Cents <br />($280,390.13), and a 60 -day extension to complete the work; and <br />WHEREAS, the City now wishes to approve Change Order No. 3 for construction of anew <br />driveway access on the west side of Collins Avenue, south of 183rd Street, in an amount not to <br />exceed Fifty -Eight Thousand Three Hundred Thirty -One Dollars and Twenty -One Cents <br />($58,331.21), attached hereto as Exhibit "A ", bringing the total amount of the project to Three <br />Hundred Thirty -Eight Thousand Seven Hundred Twenty -One Dollars and Thirty -Four Cents <br />($338,721.34). <br />82012- Tenex Change Order 3 Driveway Cut Collins 183 St Page 1 of 2 <br />
