RESOLUTION NO. 2017- VA 0 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, APPROVING A <br /> REQUEST SUBMITTED BY GSF ACQUISITION, LLC <br /> ("ESTATES AT ACQUALINA") WAIVING THE <br /> REQUIREMENT OF A CONSTRUCTION FENCE <br /> INSTALLATION PRIOR TO COMMENCING <br /> CONSTRUCTION, AND WAIVING THE LANDSCAPING AND <br /> SETBACK REQUIREMENTS FOR THE TEMPORARY <br /> CONSTRUCTION FENCE; AUTHORIZING THE CITY <br /> MANAGER TO DO ALL THINGS NECESSARY TO <br /> EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City Commission approved Zoning Resolution No. 14-Z-144, adopted <br /> on September 18th, 2014 and later modified by Zoning Resolution No. 15-Z-153, adopted on April <br /> 16`h, 2015 for the Estates at Acqualina ("Project") located at 17901 Collins Avenue; and <br /> WHEREAS, GSF Acquisition, LLC (the "Applicant") is requesting a waiver of the <br /> requirement of the installation of a construction fence prior to commencing any construction of <br /> the Project; and <br /> WHEREAS, the Applicant is also requesting a waiver of the landscaping and setback <br /> requirements for the installation of the construction fence; and <br /> WHEREAS,the City Commission wishes to approve the waivers to provide the Applicant <br /> the flexibility to install the construction fence without the required setback and landscaping buffer <br /> and prior to construction activity. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Approval of Waiver. The City Commission hereby approves the waiver of the <br /> installation of the construction fence prior construction of the Project and approves the waiver of <br /> the landscaping and setback requirements set forth in Section 265-63.3 E of the City Code for the <br /> Project, subject to the conditions below. <br /> Section 2. Conditions. The Applicant is required to comply with the following conditions: <br /> (1) The construction fence must be properly maintained at all times; and <br /> (2) The construction fence must be removed if the zoning approval expires for the <br /> project Estates of Acqualina or a building permit is not obtained within the time <br /> permitted under the zoning approval. <br />
