RESOLUTION NO. 2014- R', <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF <br />POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME <br />CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION <br />932.7055, F.S., TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE <br />DEPARTMENT OF JUSTICE (DOJ) TO PURCHASE THREE (3) POLICE <br />MOTORCYCLES, AND EMERGENCY LIGHTING AND EQUIPMENT <br />LISTED ON THE ATTACHED CERTIFICATION, IN AN AMOUNT NOT <br />TO EXCEED SIXTY -EIGHT THOUSAND SIX HUNDRED NINETY -SIX <br />DOLLARS AND TWENTY -EIGHT CENTS (S68,696.28); PROVIDING <br />FOR AN EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984. the City <br />and its Police Department are authorized to expend forfeiture funds from the established Department <br />of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to <br />enhance law enforcement purposes; and <br />WHEREAS, in accordance with Florida Statutes §932.7055(4)(c)(3) specifically, a law <br />enforcement agency that acquires at least $15,000.00 pursuant to the Florida Contraband Forfeiture <br />Act with a fiscal year must expend or donate no less than 15% of such proceeds for the support or <br />operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe <br />neighborhood, school resource officer programs or for other law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification that <br />the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request for the purchase of three (3) Harley <br />Davidson Road King Police Motorcycles, and Emergency Lighting and Equipment listed on the <br />attached Certification, in an amount of up to Sixty -Eight Thousand Six Hundred Ninety -Six Dollars <br />and Twenty -Eight Cents ($68,696.28) in forfeiture (DOJ) funds in compliance with the <br />aforementioned legal requirements. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Partial Federallv Forfeited Monies. Based on the attached certification, <br />the Chief of Police is hereby authorized to spend up to Sixty -Eight Thousand Six Hundred Ninety - <br />Six Dollars and Twenty -Eight Cents ($68,696.28) from the established Department of Justice (DOJ) <br />federal forfeitures account for the purchase of three (3) Police Motorcycles, and Emergency Lighting <br />and Equipment. <br />82014- Police Forfeiture (DOJ) Expend Funds Motorcycles Page 1 of 2 <br />
