<br />THIS NINTH AMENDMENT to the Agreement between the City of Sunny Isles Beach("City"and Lukes' Landscaping, Inc.,d/b/a/Lukes-Sawgrass Landscape, Inc.,("Contractor")executed this 15dayofMqEr , 2016, is made a part of the original Agreement between the parties datedAugust21, 2012, Contract No. 1112-057 ("the Agreement") between the City and Contractor attachedheretoasAttachment"B",whose Federal Identification#is 59-1587233. The City and Contractor herebyagreeasfollows:
<br />1. SERVICES TO BE PERFORMED. The Scope of Services, as set forth in Section Two of the
<br />Agreement between the parties, is hereby amended to include Right of Ways, Parks, and Beach Accesslandscapingservices("Additional Services"),as more particularly described in Attachment"A",a copy ofwhichisattachedheretoandmadeparthereof.
<br />2. OPTION TO RENEW. Pursuant to Section Four of the Agreement between the parties, the Cityherebyexercisesitsfourthandfinaloptionalone (1) year renewal term. The term of this renewal shall
<br />commence on October 15,2016 and shall terminate no later than October 14,2017.
<br />3. COMPENSATION FOR THIS NINTH AMENDMENT. The payment to the Contractor, as
<br />set forth in Section Five of the Original Agreement, is hereby amended to include Compensation for the
<br />Services to be perfornied for this one (1) year renewal term during Fiscal Year 2016-2017, in an amount
<br />not to exceed Eight Hundred Eighty Six Thousand Six Hundred Twenty Nine Dollars($886,629.00).d
<br />4. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, all
<br />terms and conditions of the original Agreement between the parties, dated August 21, 2012, shall remaininfullforceandeffect.
<br />5. CONFLICTING PROVISIONS. The terms and provisions contained in this Ninth Amendment
<br />shall prevail and be given superior effect and priority over any conflicting or inconsistent terms and
<br />provisions contained in any other document or attachment, including but not limited to Attachment "A"
<br />and Attachment"B".
