ORDINANCE NO. 2017 - St O <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, EXTENDING <br /> THE TIME ON THE MORATORIUM ON THE SUBMITTAL, <br /> PROCESSING, AND ISSUANCE OF LOCAL BUSINESS <br /> TAX RECEIPTS AND/OR LAND USE APPROVALS FOR <br /> MEDICAL MARIJUANA DISPENSING ORGANIZATIONS <br /> AND TREATMENT CENTERS, AS DEFINED HEREIN, <br /> FOR A PERIOD OF ONE HUNDRED EIGHTY (180) DAYS <br /> FROM THE DATE OF ADOPTION OF THIS ORDINANCE; <br /> PROVIDING FOR LEGISLATIVE FINDINGS, INTENT AND <br /> PURPOSE; PROVIDING FOR CONFLICT; PROVIDING <br /> FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE <br /> DATE. <br /> WHEREAS, January 19, 2017, the City Commission adopted Ordinance NO. 2017-491 <br /> establishing a moratorium on the submittal, processing and issuance of local business tax receipts <br /> and/or land use approvals for medical marijuana dispensing organizations and treatment centers for <br /> a period of one hundred eighty days (180); and <br /> WHEREAS, the purpose of the moratorium is to allow City staff time to thoroughly <br /> research and analyze impacts to the City, its residents, and its visitors and to develop land use <br /> regulations for Medical Marijuana Dispensing Organizations and Medical Marijuana Treatment <br /> Centers; and <br /> WHEREAS, the Florida legislature has yet to pass laws regulating the medical marijuana <br /> dispensing and therefore, the City Commission deems it necessary and in the best interests of the <br /> health, safety, and welfare of the residents and visitors of the City of Sunny Isles Beach to extend <br /> the temporary moratorium on the issuance of business tax receipts and land use approvals for <br /> another period of one hundred and eighty (180) days to allow the state to enact the laws regarding <br /> any applications for any Medical Marijuana Dispensing Organization and Medical Marijuana <br /> Treatment Center. <br /> NOW,THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part of this Ordinance. These <br /> clauses represent the legislative findings of the City Commission. It is the purpose and intent of this <br /> Ordinance to promote the health, safety, and welfare of the residents and visitors of the City of Sunny <br /> Isles Beach. <br /> Section 2. Definition. For purposes of this Ordinance a "Medical Marijuana Dispensing <br /> Organization" and "Medical Marijuana Treatment Center" shall be defined as a business and/or a <br /> location or place permitted by State law to acquire, cultivate, possess, process, transfer, transport, <br /> 1 <br />
