RESOLUTION NO. 12-Z--_-_ <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING THE <br /> SITE PLAN APPLICATION SUBMITTED BY PALERMO BEACH, <br /> LLC (THE "APPLICANT"), PURSUANT TO SECTION 265-18 OF <br /> THE CODE OF THE CITY OF SUNNY ISLES BEACH FOR A 42 <br /> STORY, 64 UNIT CONDOMINIUM BUILDING WITH 222,245 <br /> SQUARE FEET OF FLOOR AREA RATIO ("FAR"), AND ALSO <br /> APPROVING THE TRANSFER OF DEVELOPMENT RIGHTS <br /> ("TDRS") APPLICATION IN THE AMOUNT OF 51,287 SQUARE <br /> FEET OF FLOOR AREA AND 27 DWELLING UNITS FROM A <br /> PRIVATE TDR BANK ACCOUNT; PROVIDING THE CITY <br /> MANAGER WITH THE AUTHORITY TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br /> FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING <br /> FOR AN EFFECTIVE DATE. <br /> I. RECITALS <br /> WHEREAS, Palermo Beach, LLC (the "Applicant") submitted a site plan application <br /> No. Z2012-14 to the City of Sunny Isles Beach, Florida (the "Application") requesting the <br /> following: <br /> 1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting a site plan approval for a 42 story, 64 unit <br /> condominium building with 222,245 square feet of floor area ratio ("FAR"). <br /> f <br /> 2. Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting the utilization of private TDRs in the <br /> amount of 51,287 square feet of development rights and 27 dwelling units. <br /> 3. Pursuant to Section 265-35(D)(8) of the City of Sunny Isles Beach Land <br /> Development Regulations, the Applicant is requesting a waiver of the required <br /> beach access easement for public safety reasons. <br /> 4. Pursuant to Section 265-63.3(G) of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting the use of graphics and murals on <br /> temporary construction fencing. <br /> LEGAL: Portion of Govt. Lot 6.
