<br />City of Sunny Isles Beach |Request for Qualifications No. 18-02-01 13 <br /> <br />(1) Are not presently debarred, suspended, proposed for debarment, declared ineligible, or <br />voluntarily excluded from participating in covered transactions by any Federal department or <br />agency; <br /> <br />(2) Have not within a three-year period preceding this proposal been convicted of or had a civil <br />judgment rendered against them for commission of fraud or a crimina l offense in connection with <br />obtaining, attempting to obtain, or performing a public (Federal, State or local) transaction or <br />contract under a public transaction; violation of Federal or State antitrust statutes or commission <br />of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false <br />statements, or receiving stolen property; <br /> <br />(3) Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity <br />(Federal, State or local) with commission of any of the offenses enumerated in paragraph (a)(2) <br />of this certification; and <br /> <br />(4) Have not within a three-year period preceding this application/proposal had one or more public <br />transactions (Federal, State or local) terminated for cause or default. <br /> <br />b. Where the prospective participant is unable to certify to any of the statements in this certification, <br />such prospective participant shall attach an explanation to this proposal. <br /> <br />2.14 E-VERIFY <br /> <br />Contractor acknowledges that the City may be utilizing the Contractor’s services for a project that <br />is funded in whole or in part by State funds pursuant to a contract between the City and a State <br />agency. Contractor shall be responsible for complying with the E-Verify requirements in the contract <br />and using the U.S. Department of Homeland Security’s E-Verify system to verify the employment <br />of all new employees hired by Contractor during the Agreement term. The Contractor is also <br />responsible for e-verifying its subcontractors, if any, pursuant to any agreement between the City <br />and a State Agency, and reporting to the City any required information. Contractor acknowledge- <br />edges that the terms of this paragraph are material terms, the breach of any of which constitute a <br />default under the Agreement. <br /> <br />2.15 DISCRIMINATION/NONDISCRIMINATION <br /> <br />A. Any entity or affiliate who has been placed on the discriminatory vendor list may not submit a <br />bid on a contract to provide goods or services to a public entity, may not submit a bid on a contract <br />with a public entity for construction or repair of a public building or public work, may not submit <br />bids on leases of real property to a public entity, may not award or perform work as a contractor, <br />supplier, subcontractor, or consultant under contract with any public e ntity, and may not transact <br />business with any public entity. <br /> <br />B. During the performance of this Contract, Proposer agrees to not discriminate against any <br />employee or applicant for employment because of race, religion, color, sex, handicap, marital <br />status, age or national origin, and will take affirmative action to ensure that they are afforded equal <br />employment opportunities without discrimination.
