D. Public Records Request for Appeal Hearing: Copies of documents in the City's control which are <br /> intended to be used at the hearing, and which directly relate to the issuance of the trespass warning to <br /> the appellant, shall be made available upon request to the appellant at no cost. <br /> E. Appeal Hearing: <br /> (a) The appellant shall have the right to attend with an attorney, to testify and to call witnesses, <br /> cross examine witnesses, and present evidence. The appellant shall have the right to bring a court <br /> reporter, at appellant's own expense. <br /> (b) The Special Magistrate shall consider the testimony, reports or other documentary evidence, <br /> and any other evidence presented at the hearing. Formal rules of evidence shall not apply, but <br /> fundamental due process shall govern the proceedings. <br /> (c) The City shall bear the burden of proof by a preponderance of the evidence that the trespass <br /> warning was properly issued pursuant to the criteria of this section. <br /> (d) If the appellant fails to attend a scheduled hearing, the Special Magistrate shall review the <br /> evidence presented and determine if the trespass warning was properly issued pursuant to the <br /> criteria of this section. <br /> F. Decision of Appeal: <br /> (a) Within five (5) days of the hearing, the Special Magistrate shall issue a written decision on the <br /> appeal which shall be mailed to the appellant at the address provided. If no address is provided, a <br /> copy of the decision shall be posted at the information desk of the Sunny Isles Beach Police <br /> Department. <br /> (b) The decision of the Special Magistrate shall be final and the appellant shall be deemed to have <br /> exhausted all administrative remedies. Such decision may be subject to judicial review in the <br /> manner provided by law by the appellant. The City may not appeal any decision of the Special <br /> Magistrate. <br /> (c) The trespass warning shall remain in effect during the appeal and review process, including <br /> any judicial review. <br /> Section 3. Inclusion in the Code. It is the intention of the City Commission, and it is hereby • <br /> ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny <br /> Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to <br /> accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other <br /> appropriate word, as required. <br /> Section 4. Severability. The provisions of this Ordinance are declared to be severable and if <br /> any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br /> or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, <br />
