6.3. City's to Withhold Par ment. The City may withhold in whole or in <br /> part, final payment or any progress payment to such extent as may be necessary to <br /> protect itself from loss on account of: <br /> 6.3.1 Defective Work not remedied. <br /> 6.3.2 Claims filed or reasonable evidence indicating the probable filing <br /> of claims by other parties against the Contractor. <br /> 6.3.3 Failure of the Contractor to make payment to subcontractors or <br /> suppliers for materials or labor. <br /> 6.3.4 Damage to another contractor not remedied. <br /> 6.3.5 Liability for liquidated damages has been incurred by Contractor. <br /> 6.3.6 Reasonable evidence that the Work cannot be completed for the <br /> unpaid balance of the contract sum. <br /> 6.3.7 Reasonable evidence that the Work will not be completed within <br /> the Contract time. <br /> 6.3.8 Failure to carry out the Work in accordance with the Contract <br /> Documents. <br /> 7. INDEPENDENT CONTRACTOR RELATIONSHIP. The Contractor is an <br /> independent contractor and shall be treated as such for all purposes. Nothing contained <br /> in this agreement or any action of the parties shall be construed to constitute or to render <br /> the Contractor an employee, partner, agent, shareholder, officer or in any other capacity <br /> other than as an independent Contractor other than those obligations which have been or <br /> shall have been undertaken by the City. Contractor shall be responsible for any and all of <br /> its own expenses in performing its duties as contemplated under this agreement. The <br /> City shall not be responsible for any expense incurred by the Contractor. The City shall <br /> have no duty to withhold any Federal income taxes or pay Social Security services and <br /> that such obligations shall be that of the Contractor, other than those set forth in this <br /> agreement. Contractor shall furnish its own transportation, office and other supplies as it <br /> determines necessary in carrying out its duties under this agreement. <br /> 8.
