RESOLUTION NO. 2018- Z 3 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, APPROVING SITE PLAN <br /> CONDITION MODIFICATION FOR THE ESTATES AT <br /> ACQUALINA PROJECT BY A3 DEVELOPMENT, LLC (THE <br /> "APPLICANT") FOR PROJECT LOCATED AT 17901 COLLINS <br /> AVENUE; PROVIDING THE CITY MANAGER AND CITY <br /> ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THE TERMS OF THIS <br /> RESOLUTION; PROVIDING FOR AND EFFECTIVE DATE. <br /> WHEREAS, the City Commission approved the site plan application for A3 <br /> Development, LLC ("Applicant") pursuant to Zoning Resolution Nos. 18-Z-165, 15-Z-153, and <br /> 14-Z-144 ("Resolutions"); and <br /> WHEREAS, the Applicant has requested the modification of certain conditions stipulated <br /> under the Resolutions; and, <br /> WHEREAS, the City Commission wishes to approve the modification of the conditions <br /> of the approved site plan based on the recommendation of the Office of the City Manager. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Approval of Site Plan Condition Modification. The City Commission hereby <br /> approves the modification of conditions for the approved site plan for the Project based on the <br /> recommendation of the Office of the City Manager subject to certain conditions. The following <br /> are the conditions being modified: <br /> Pursuant Resolution 18-Z-165 Condition (9): <br /> If the Applicant intends to use the Golden Strand Parking Lot for parking purposes, the <br /> Applicant shall submit a site plan application for the Golden Strand Parking Lot and such <br /> site plan shall designate parking for the Acqualina Sales Center Offices and the Estates of <br /> Acqualina to ensure compliance with parking requirements. Such application must be <br /> submitted prior to the issuance of the below grade building permit or master building <br /> permit of a TCO or CO for Phase I for the Estates at Acqualina. Such Parking Lot shall <br /> obtain Temporary Certificate of Occupancy (TCO) or Certificate of Occupancy (CO) <br /> prior to the issuance of the TCO or CO of the North Tower of the Project. <br /> Pursuant Resolution 18-Z-165 Condition (14): <br /> That the Applicant shall obtain approval from the Public Art Advisory Committee <br /> . • _ _ •_ <br /> Resolution Amending Estates at Acqualina Site Plan Conditions Page 1 of 2 <br />
