RESOLUTION NO. 2018- at) <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br /> ISLES BEACH, FLORIDA, APPROVING SALE AND PURCHASE <br /> AGREEMENT AND RELATED EASEMENT AGREEMENTS BY AND <br /> BETWEEN WINSTON TOWERS 600 CONDOMINIUM ASSOCIATION, INC. <br /> AND THE CITY OF SUNNY ISLES BEACH FOR THE PROPERTY LOCATED <br /> AT 174 STREET AND COLLINS AVENUE, ATTTACHED HERETO IN <br /> SUBSTANTIALLY THE SAME FORM AS EXHIBITS "A", "B", "C" AND "D"; <br /> PROVIDING THE MAYOR WITH THE AUTHORITY TO EXECUTE SAID <br /> SALE AND PURCHASE AGREEMENT; PROVIDING THE CITY MANAGER <br /> AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; <br /> PROVIDING DIRECTION TO THE CITY CLERK TO RECORD SAID <br /> EASEMENT AGREEMENTS IN THE PUBLIC RECORDS OF MIAMI-DADE <br /> COUNTY; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, Winston Towers 600 Condominium Association, Inc. ("Winston Towers") is the <br /> owner of a certain property located at 174 Street and Collins Avenue, Sunny Isles Beach, Florida; and <br /> WHEREAS, the City desires to construct a Pedestrian Overpass Bridge on 174 Street to <br /> connect the west and east sides of Collins Avenue (the "Pedestrian Bridge"); and <br /> WHEREAS, the City has negotiated with Winston Towers an agreement for purchase of <br /> certain property located on 174 Street and Collins Avenue and related easements necessary for <br /> construction of the bridge, and for, landscaping, sidewalk expansion and installation of utilities; and <br /> WHEREAS, the City Commission wishes to approve the Sale and Purchase Agreement for the <br /> property located at 174 Street and Collins Avenue in substantially the same form as attached Exhibit <br /> "A"; and <br /> WHEREAS, the City Commission wishes to approve the Easement Agreements for sidewalk <br /> expansion, landscaping, installation of utilities, maintenance of the Pedestrian Bridge, in substantially <br /> the same form as attached Exhibit "B", "C", and "D". <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Approval of Sale and Purchase Agreement. The City Commission hereby approves the <br /> Sale and Purchase Agreement by and between Winston Towers 600 Condominium Association, Inc. <br /> and the City of Sunny Isles Beach for certain property legally described in Exhibit "A". <br /> Section 2. Approval of Related Easement Agreements. The City Commission hereby approves the <br /> Permanent Easement Agreement, Temporary Construction Easement Agreement and Utility Easement <br /> Agreement by and between Winston Towers 600 Condominium Association, Inc. and the City of <br /> Sunny Isles Beach are hereby approved in substantially the same form as the attached Exhibit "B", <br /> Exhibit "C" and Exhibit "D''. <br /> R2018-WT 600— 174 St Pedestrian Bridge Agreements 1 <br />
