A. Subject to § 129 69 below, the City Manager or his designee may suspend any <br /> following reasons: <br /> (1) Failure to satisfy permit conditions, including conditions set forth in this <br /> article or other applicable City ordinances, codes or regulations governing <br /> placement or maintenance of communications facilities in public rights of <br /> way, including, without limitation, failure to take reasonable safety <br /> precautions to alert the public of work at the work site, or to restore any <br /> public rights of way; <br /> (2) Misrepresentation or fraud by registrant in a registration or permit <br /> application to the City; or <br /> (3) Inaccurate information contained in a permit application; or <br /> (1) Failure to properly renew or ineffectiveness of registration. <br /> (5) Failure to relocate or remove facilities as may be lawfully required by the <br /> Gity. <br /> 13. The City Manager or his designee shall provide notice and an opportunity to cure <br /> circumstances. <br /> () Prior to the issuance of any permit in accordance with this Ordinance. or performing <br /> any work in the public rights-of-way, either pursuant to a permit or without a permit <br /> if authorized by applicable law except in the case of an emergency pursuant to this <br /> Ordinance, a registrant shall establish in the City's favor a performance construction <br /> bond to secure the restoration of the public rights-of-way, and to ensure the <br /> registrant's faithful performance of the construction-or other work in the public <br /> rights-of-way. in accordance with applicable sections of the City Code and the <br /> permit. The performance construction bond must name the City as obligee and be <br /> conditioned upon the full and faithful compliance by the registrant with all <br /> requirements. duties, and obligations imposed by the permit and provisions of this <br /> Ordinance during and through completion of the placement or maintenance project. <br /> The performance construction bond shall be in an amount as determined by the City <br /> based on one-hundred ten percent (110%) of the estimated costs of the restoration of <br /> the public rights-of-way. No performance construction shall be required if the <br /> estimated costs of the restoration of the public rights-of-way is less than one <br /> thousand dollars ($1.000) provided the registrant has a fully replenished permanent <br /> performance bond on file with the City. For a consolidated permit, the registrant <br /> shall provide a performance construction bond based on the amount of the total costs <br /> of the restoration of the public rights-of-way for all small wireless facilities to be <br /> collocated on utility poles within the public rights-of-way. but in no event shall be <br /> less than ten thousand dollars ($10,000). The minimum amount of the performance <br /> construction bond for a new or replaced utility pole or ground-mounted small <br /> wireless facility up to twenty-eight (28) cubic feet shall be twenty-five thousand <br /> dollars ($25,000). The construction bond shall be issued by a surety licensed to <br /> operate in Florida having a minimum rating of A-1 in Best's Key Rating Guide. <br /> Property/Casualty Edition; shall be subject to the approval of the City Attorney and <br /> may be administratively accepted by the City Manager. <br /> 51 <br /> City of Sunny Isles Beach CROW Ordinance 10-17-18 <br />
