RESOLUTION NO. 2013 -. lo <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH,FLORIDA,APPROVING CHANGE ORDER <br /> NO. 1 TO AGREEMENT WITH USA SHADE & FABRIC <br /> STRUCTURES, INC. FOR THE INSTALLATION OF A <br /> PLAYGROUND CANOPY AT HERITAGE PARK, IN AN AMOUNT <br /> NOT TO EXCEED SEVEN THOUSAND FIVE HUNDRED THIRTY- <br /> FIVE DOLLARS, ($7,535.00), ATTACHED HERETO AS EXHIBIT <br /> "A", BRINGING THE TOTAL CONTRACT AMOUNT TO THREE <br /> HUNDRED FORTY-TWO THOUSAND ONE HUNDRED FIFTY- <br /> EIGHT DOLLARS (S342,158.00); AUTHORIZING THE CITY <br /> MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE <br /> THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, on July 1, 2011, the City advertised and issued Request for Proposals (RFP) <br /> No. 11-10-01 for the design,permitting,and installation of the playground canopies at Heritage Park <br /> and Golden Shores Park; and <br /> WHEREAS, on December 22, 2011 via Resolution No. 2011-1830 the City Commission <br /> approved an Agreement with USA Shade & Fabric Structures, Inc. for the design, permitting, and <br /> installation of the playground canopies at Heritage Park and Golden Shores Park, in an amount not to <br /> exceed Three Hundred Thirty-Four Thousand Six Hundred Twenty-Three Dollars($334,623.00);and <br /> WHEREAS, in the course of performing the work, the installers encountered an unknown <br /> underground condition, specifically an asphalt parking lot that delayed the project and incurred <br /> additional expenses in equipment rental and personnel to complete the project; and <br /> WHEREAS,USA Shade&Fabric Structures,Inc.is seeking compensation to account for the <br /> additional scope of work that was unknown at the time of contract award,and provided the City with <br /> Change Order No. 1 in an amount not to exceed Seven Thousand Five Hundred Thirty-Five Dollars <br /> ($7,535.00); and <br /> WHEREAS, the City wishes to approve Change Order No. 1 to the Agreement with USA <br /> Shade& Fabric Structures, Inc. for the additional scope of work for the installation of a Playground <br /> Canopy at Heritage Park, in an amount of Seven Thousand Five Hundred Thirty-Five Dollars <br /> ($7,535.00), attached hereto as Exhibit "A", bringing the total contract amount not to exceed to <br /> Three Hundred Forty-Two Thousand One Hundred Fifty-Eight Dollars ($342,158.00). <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Approval of Change Order No. 1 to Agreement. The City Commission hereby <br /> approves Change Order No. 1 to Agreement with USA Shade & Fabric Structures, Inc. for the <br /> installation of a playground canopy at Heritage Park, in an amount not to exceed Seven Thousand <br /> Five Hundred Thirty-Five Dollars ($7,535.00), attached hereto as Exhibit "A", bringing the total <br /> 82013-USA Shade CO Ito Agmt Canopy at Heritage Pk Page I of 2 <br />
