RESOLUTION NO. 22-Z- I al <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A SITE PLAN MODIFICATION APPLICATION (PZ2021-22) <br />SUBMITTED BY LA PLAYA BEACH ASSOCIATES, LLC, FOR THE PROJECT ENTITLED <br />"LA PLAYA BEACH" FORMERLY KNOWN AS, "LA PLAYA VARADERO", LOCATED <br />AT 18801 COLLINS AVENUE, TO INCREASE THE HEIGHT OF BOTH THE NORTH AND <br />SOUTH TOWERS BY FIVE (5) STORIES, TO INCREASE THE FLOOR AREA RATIO <br />(FAR) BY 281 SQUARE FEET BRINGING THE OVERALL FAR OF THE PROJECT TO <br />5.98 FAR OR 1,228,435 SQUARE FEET, TO ALLOW FOR A CONDITIONAL USE TO <br />INCLUDE A PRIVATE MEMBERS CLUB, OFFERING LA PLAYA RESIDENT AND <br />PUBLIC ACCESS TO A PRIVATE SPA TOTALING 8,000 SQUARE FEET AND A BEACH <br />BAR AND GRILL RESTAURANT TOTALING 5,200 SQUARE FEET (INDOOR AND <br />OUTDOOR DINING), TO INCLUDE A RESTAURANT OPEN TO THE PUBLIC <br />TOTALING 8,462 SQUARE FEET (INDOOR AND OUTDOOR DINING), TO MODIFY <br />THE BUILDING AMENITIES TO INCLUDE 17 CABANAS AND 13 GUEST SUITES, TO <br />ALLOW A SHARED PARKING AGREEMENT BETWEEN THE SPA AND RESTAURANT <br />USES, TO ALLOW FOR A PAYMENT AGREEMENT FOR THE APPROVED TRANSFER <br />DEVELOPMENT RIGHTS (TDRS) AND FAR BONUSES ON TERMS AS APPROVED BY <br />THE CITY COMMISSION, TO ALLOW FOR AN EXTENSION OF TIME TO PULL A <br />BUILDING PERMIT FOR A TOTAL OF 72 MONTHS FROM THE DATE OF SITE PLAN <br />APPROVAL, TO ALLOW USE OF TEMPORARY MURALS AND GRAPHICS ON A <br />TEMPORARY CONSTRUCTION FENCE; PROVIDING THE CITY MANAGER WITH <br />THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, La Playa Beach Associates, LLC (the "Applicant") is seeking approval to modify <br />the approved site plan pursuant to Resolution No. 15-Z-156 adopted on November 19, 2015 <br />which included two 56 -story towers consisting of 431 residential condominiums, 60 hotel units <br />and 90 apartment -hotel units and 1,228,435 square feet of floor area ratio (FAR), which was later <br />modified pursuant to Resolution No. 16-Z-158 adopted April 21, 2016, to include two 56 -story <br />towers consisting of 490 residential condominiums, 12 cabanas, 7,781 square feet of restaurant <br />space, 7,780 square feet office space and 1,850 square feet of retail space and 1,228,154 square <br />feet of FAR; and <br />WHEREAS, the Applicant's site plan modification application requests the following: <br />1. Pursuant to Section §265-18 and §265-35 of the City of Sunny Isles Beach Land <br />Development Regulations, the Applicant is requesting a Site Plan Modification for the <br />project "La Playa Beach" formerly known as, "La Playa Varadero". The proposed <br />modification includes a height increase of 5 stories for both the north and south <br />condominium towers, bringing the north and south condominium towers to a maximum <br />of 62 stories or 750'-0" NGVD. Additionally, the Applicant is requesting an increase of 281 <br />square feet of Floor Area Ratio (FAR), for a total of 5.98 FAR or 1,228,435 square feet of <br />
