RESOLUTION NO. 2026 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, DIRECTING THE CITY MANAGER TO ASSIST THE ATLANTIC ISLES CIVIC <br />ASSOCIATION IN DEVELOPING A RIGHT-OF-WAY AGREEMENT AND ANY <br />RELATED AGREEMENTS NECESSARY TO PERMIT THE INSTALLATION OF A <br />VEHICULAR GATE ARM SECURITY SYSTEM AT THE ENTRANCE OF THE ATLANTIC <br />ISLES NEIGHBORHOOD, SUBJECT TO COMMISSION APPROVAL; AUTHORIZING <br />THE CITY AND CITY ATTORNEY TO DO ALL THINGS NECESSARY TO EFFECTUATE <br />THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the Atlantic Isles Civic Association (the "Association") has expressed a desire <br />to install a vehicular gate arm security system across a City -owned public roadway within the <br />Atlantic Isles neighborhood for the purpose of slowing vehicular traffic entering the community; <br />and <br />WHEREAS, the proposed gate arm would not require a key fob, transponder, or other <br />access -control device for entry, and the roadway would remain a public road open for general <br />public use; and <br />WHEREAS, the City Commission wishes to provide direction to the City Manager to work <br />with the Association to develop a Right -of -Way Agreement and any related agreements <br />necessary to effectuate the installation of the proposed gate arm security system, subject to <br />approval by the City Commission; and <br />WHEREAS, it is the intent of the City Commission that all costs associated with the <br />design, engineering, permitting, installation, operation, electricity and power usage, repair, <br />replacement, insurance, and ongoing maintenance of the gate arm security system shall be <br />borne solely by the Association. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Direction to City Manager., The City Commission hereby directs the City Manager <br />to assist he Association with the development a Right -of -Way Agreement and any related <br />agreements necessary to permit the installation of a vehicular gate arm security system across a <br />City roadway within the Atlantic Isles neighborhood. <br />Section 2. Authorization of City Manager and City Attorney. The City Manager and City <br />Attorney are hereby authorized to do all things necessary to effectuate this Resolution. <br />Section 3.
