RESOLUTION NO. 2026 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, PROVIDING A MERIT SALARY ADJUSTMENT FOR CITY CLERK MAURICIO BETANCUR; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 18, 2024, pursuant to Resolution No. 2024-3612, the City Commission appointed Mauricio Betancur as City Clerk and approved an Employment Agreement with him to serve as City Clerk; and WHEREAS, the Employment Agreement between the City of Sunny Isles Beach and City Clerk Mauricio Betancur (hereinafter "Agreement") provides that the City Clerk "shall receive periodic merit increases as determined by the City Commission in its reasonable discretion; provided, however, the Employee shall receive an automatic yearly cost of living adjustment in the amount of three percent (3%) of his annual salary on the anniversary date of approval of this Agreement"; and WHEREAS, the Agreement further provides that "[t]he City Commission may evaluate the performance of the Employee to determine any adjustment in annual salary and/or benefits at least once annually, during the City's Annual Budget process," and that "[a]ny adjustments in said annual salary and/or benefits should be based upon the results of the performance evaluation, within the sole discretion of the City Commission;" and WHEREAS, pursuant to the Agreement, the City Clerk's initial annual base salary was $148,899.11, and since being appointed City Clerk, and in accordance with the Agreement, the City Clerk has received annual cost of living adjustments in the amount of three percent (3%) of his annual salary, resulting in a current salary of $157,967.00; and WHEREAS, since being appointed on January 18, 2024, the City Clerk has not been provided with or received any performance evaluation or merit increase from the City Commission; and WHEREAS, based upon his performance since being appointed as City Clerk, the City Commission has determined that City Clerk Mauricio Betancur merits an increase of his annual base salary to $200,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Merit Increase. City Clerk Mauricio Betancur's annual base salary is hereby increased to $200,000.00, effective April 26, 2026. Section 2. Authorization of City Manager.
