RESOLUTION NO. 2026 - _494 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FIRST AMENDMENT TO THE AGREEMENT AND <br />CONSENT TO ASSIGNMENT WITH PHILLIPS HEAVY, INC., F/K/A PHILLIPS & <br />JORDAN, INCORPORATED, AS THE SECONDARY CONTRACTOR, TO PROVIDE <br />DISASTER DEBRIS MANAGEMENT AND REMOVAL SERVICES, ATTACHED <br />HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, on June 15, 2023, the City Commission of the City of Sunny Isles Beach, <br />through Resolution No. 2023-3514, awarded Request for Proposals No. 23-04-01 to, and <br />approved an Agreement with, Phillips & Jordan, Incorporated, as the secondary contractor to <br />provide disaster debris management and removal services in the event of an emergency (the <br />"Services"); and <br />WHEREAS, the City Commission approved the Agreement for an initial term of three (3) <br />years, with an option to renew for an additional two (2) year term (the "Renewal Option"); and <br />WHEREAS, since the approval of the Agreement, Phillips & Jordan, Incorporated, has <br />undergone a corporate name change to Phillips Heavy, Inc. (the "Secondary Contractor"); and <br />WHEREAS, the Secondary Contractor possesses the requisite qualifications, expertise, <br />and licenses to perform all necessary work in connection with the Services specified in the RFP, <br />and have expressed its desire to provide the Services to the City; and <br />WHEREAS, the City Manager recommends consenting to the assignment of the <br />Agreement from Phillips & Jordan, Incorporated, to Phillips Heavy, Inc., and 'exercising the <br />Renewal Option, to expire in June 2028; and <br />WHEREAS, the City Commission wishes to approve a First Amendment to the Agreement <br />and consent to assignment with the Secondary Contractor to provide the Services on an as - <br />needed basis, attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of First Amendment and Consent to Assignment. The City Commission <br />hereby consents to the assignment of the Agreement to Phillips Heavy, Inc., and approves a First <br />Amendment to the Agreement with the Secondary Contractor to provide the Services on an as - <br />needed basis, attached hereto as Exhibit "A". <br />Section 2.
