RESOLUTION NO. 15-Z - I SR, <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING A SITE <br /> PLAN APPLICATION SUBMITTED BY RDR SEASHORE, LLC <br /> (THE "APPLICANT") FOR A 56 STORY RESIDENTIAL <br /> CONDOMINIUM WITH 308 DWELLING UNITS AND 811,560 <br /> SQUARE FEET OF FLOOR AREA; PROVIDING THE CITY <br /> MANAGER WITH THE AUTHORITY TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br /> FOR SEVERABILITY; PROVIDING FOR REPEALER; <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> I. RECITALS <br /> WHEREAS, RDR Seashore, LLC (the "Applicant") submitted a site plan application <br /> (Application No. PZ201 S-06) (the "Application") to the City of Sunny Isles Beach, Florida <br /> requesting the following: <br /> 1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting a site plan approval for a 56-story residential <br /> condominium with 308 dwelling units and with a total Floor Area Ratio (FAR) of 811,560 <br /> square feet. <br /> 2. Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting the utilization and assignment of public TDRs in <br /> the amount of 118,589 square feet of floor area and 23 dwelling units. An adjustment to be <br /> made for a decrease of 118,589 square feet of floor area and 56 dwelling units from the <br /> City's TDR Bank. <br /> 3. Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br /> Regulations, the Applicant is requesting the utilization and assignment of private TDRs in <br /> the amount of 68,694 square feet of floor area and 37 dwelling units. An adjustment will be <br /> made to close out the private TDR Bank. <br /> LEGAL: The land referred to herein below is situated in the County of Miami-Dade. <br /> State of Florida, and is described as follows: All Condominium Units, in <br /> SEASHORE CLUB SOUTH, A MOTEL CONDOMINIUM, together with <br /> an undivided interest in the common elements, according to the Declaration <br /> of Condominium thereof, as recorded in Official Record Book 10709, Page <br /> 380, as amended from time to time, of the Public Records of Miami-Dade <br /> County, Florida. To be known as: The South 200 feet of Tract "E" of <br /> Amended Plat of NORTH BISCAYNE BEACH, accordine to the Plat <br /> thereof, recorded in Plat Book 44, Page 42, of the Public Records of Miami- <br /> Dade County, Florida. AND The South 100 feet of the North 300 feet of <br /> Tract "E" of Amended Plat of NORTH BISCAYNE BEACH according to <br /> the Plat thereof recorded in Plat Book 44, Page 42, of the Public Records of <br /> Miami-Dade County, Florida.
