ORDINANCE NO. 2013 - ` l( <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 197-18 OF <br /> THE CITY CODE TO PREVENT ILLEGAL SURCHARGE FOR USE OF <br /> CREDIT CARD BY CONSUMERS; PROVIDING FOR SEVERABILITY; <br /> PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; <br /> PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR <br /> AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of this Ordinance is to clarify penalties against businesses for <br /> violating Section 501.0117, Florida Statutes; and <br /> WHEREAS, Section 501.0117, Florida Statutes, makes it illegal for a business to impose <br /> a surcharge on credit card payments by customers for goods and/or services, in lieu of paying by <br /> cash or check; and <br /> WHEREAS, in order to enforce this prohibition against charging surcharges on credit <br /> card payments, in lieu of payments by cash or check, the City wishes to amend Section 197-18 to <br /> specify that local business licenses may be revoked by the City for violations of Section <br /> 501.0117, Florida Statutes. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby <br /> ratified and confirmed as being true and correct and are hereby made a specific part by this <br /> Ordinance upon adoption hereof. <br /> Section 2. Amendment. Section 197-18 of the City Code is amended to read as follows: <br /> The City Business Tax Officer is granted authority and is charged with the duty to revoke, refuse <br /> to renew or suspend any receipt heretofore issued as follows: <br /> A. Grounds. The following matters shall be taken into consideration as grounds for <br /> revocation: <br /> (1) The number, frequency, and severity of complaints received from the <br /> public; <br /> (2) The number, frequency, and severity of existing code violations; <br /> (3) The number frequency and severity of similar prior code violations and or <br /> complaints; <br /> (4) The effects of continued uses and operations on the surrounding <br /> properties, including the effect on occupants and tenants thereof; <br />
