ORDINANCE NO. 2014 - <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 62 <br /> "PURCHASING" SECTION 62-13 TO CLARIFY THAT PURCHASES <br /> MADE THROUGH INTERGOVERNMENTAL COOPERATIVE <br /> PURCHASING ARRANGEMENTS OR PURCHASING CONSORTIUMS <br /> ORGANIZED AS A CORPORATION NOT FOR PROFIT WHOSE <br /> MEMBERS ARE GOVERNMENTAL ENTITIES ARE PERMITTED <br /> PROVIDED THAT SUCH CONSORTIUMS PROVIDE FOR A <br /> COMPETITIVE PROCESS FOR THE SELECTON OF A VENDOR; <br /> PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN <br /> THE CODE; PROVIDING FOR REPEAL OF CONFLICTING <br /> PROVISIONS; AND PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of Section 62-13 of the City Code is to provide for exemptions <br /> from competitive bidding procedures for certain contractual services and products; and <br /> WHEREAS, the City desires to amend Section 62-13 of the City Code to clarify that <br /> purchases made through intergovernmental cooperative purchasing arrangements or purchasing <br /> consortiums organized as a corporation not for profit whose members are governmental entities <br /> are permitted provided that such cooperative purchasing arrangements or consortiums provide <br /> for a competitive process to select a vendor. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby <br /> ratified and confirmed as being true and correct and are hereby made a specific part by this <br /> Ordinance upon adoption hereof. <br /> Section 2. Amendment. Chapter 62, "Purchasing", Section 62-13 of the City Code is <br /> amended to read as follows: <br /> § 62-13. Exemptions from competitive bidding. <br /> The following shall be exempt from the competitive bidding procedures outlined in this <br /> chapter: <br /> Purchases made through intergovernmental cooperative purchasing arrangements or <br /> purchasing consortiums organized as a corporation not for profit whose members are <br /> governmental entities provided that such cooperative purchasing arrangements or consortiums <br /> provide for a competitive process to select a vendor. <br /> Words stricken are deletions;words underlined are additions. <br />
