RESOLUTION NO. 2020- 30' 1 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br /> ISLES BEACH, FLORIDA, ACCEPTING A PERPETUAL EASEMENT <br /> AGREEMENT FROM THE STATE OF FLORIDA DEPARTMENT OF <br /> TRANSPORTATION (FDOT) FOR THE PURPOSES OF CONSTRUCTING, <br /> OPERATING, AND MAINTAINING THE SUNNY ISLES BEACH <br /> PEDESTRIAN BRIDGE OVER S.R. A-1-A/COLLINS AVENUE BETWEEN <br /> 178TH AND 180TH STREETS, ATTACHED HERETO, IN <br /> SUBSTANTIALLY THE SAME FORM AND INCORPORATED HEREIN,AS <br /> EXHIBIT "A"; AUTHORIZING THE CITY MANAGER AND THE CITY <br /> ATTORNEY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br /> RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS,the City of Sunny Isles Beach("City")wishes to construct a public pedestrian <br /> bridge over S.R. A-1-A/Collins Avenue between 178th and 180th Streets, in Sunny Isles Beach, <br /> Florida; and <br /> WHEREAS, the State of Florida Department of Transportation ("FDOT") has <br /> recommended a perpetual easement be granted to the City for the right-of-way over which the <br /> pedestrian bridge will be constructed; and <br /> WHEREAS, the City wishes to accept the Perpetual Easement Agreement from FDOT, <br /> attached hereto as Exhibit "A", assigning a Perpetual Easement for purposes of constructing, <br /> operating and maintaining a pedestrian bridge over the described land in Sunny Isles Beach, <br /> Florida, attached hereto, in substantially the same form, as Exhibit "A". <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The recitals set forth in this Resolution are incorporated <br /> herein by reference as if fully set forth herein. <br /> Section 2. Approval of Easement Agreement. The City Commission of the City of Sunny <br /> Isles Beach hereby accepts the Perpetual Easement Agreement from the State of Florida <br /> Department of Transportation, attached hereto as Exhibit "A". <br /> Section 3. Authorization of City Manager and City Attorney. The City Manager and the City <br /> Attorney are hereby authorized to do all things necessary to effectuate this Resolution. <br /> Section 4. Effective Date. This Resolution shall become effective upon adoption. <br /> PASSED AND ADOPTED on this 20th d, o ebruary 2020. <br /> George ' .
