r 1 ORDINANCE NO. 2014- L 2,9 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, CREATING A NEW ARTICLE IN CHAPTER 172 ENTITLED "CHARITABLE DONATIONS"; REQUIRING APPROVAL OF THE CITY COMMISSION FOR FINANCIAL DONATIONS TO CHARITABLE ORGANIZATIONS AND FOR DONATIONS OF IN-KIND SERVICES AND USE OF FACILITIES BY CHARITABLE ORGANIZATIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has made a commitment to support charitable organizations which provide services to the residents of the City of Sunny Isles Beach; and WHEREAS, Section 7.6 of the City Charter requires the affirmative votes of at least four (4) members of the City Commission to approve charitable contributions to any person or entity; and WHEREAS, the City Commission wishes to codify the requirement that charitable contributions by the City must be approved by the City Commission. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing " WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this ordinance upon adoption hereof. Section 2. Amendment. Chapter 172 of the Code of Ordinances of the City of Sunny Isles Beach is hereby amended to include Article II to read as follows: Article II Charitable Donations §172-4 A. Financial Donations. Cash donations to charitable organizations must be approved rov ed by the affirmative votes of at least four (4) members of the City Commission at a public meeting. B. In-Kind services and Use of Facilities. In-Kind services and use of the City's governmental facilities by charitable organizations must be approved by the affirmative votes of at least four (4) members of the City Commission at a public meeting.
