r 1 <br /> ORDINANCE NO. 2014- L 2,9 <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, CREATING A <br /> NEW ARTICLE IN CHAPTER 172 ENTITLED <br /> "CHARITABLE DONATIONS"; REQUIRING APPROVAL <br /> OF THE CITY COMMISSION FOR FINANCIAL <br /> DONATIONS TO CHARITABLE ORGANIZATIONS AND <br /> FOR DONATIONS OF IN-KIND SERVICES AND USE OF <br /> FACILITIES BY CHARITABLE ORGANIZATIONS; <br /> PROVIDING FOR SEVERABILITY; PROVIDING FOR <br /> REPEALER; PROVIDING FOR INCLUSION IN THE <br /> CODE; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City Commission has made a commitment to support charitable <br /> organizations which provide services to the residents of the City of Sunny Isles Beach; and <br /> WHEREAS, Section 7.6 of the City Charter requires the affirmative votes of at least <br /> four (4) members of the City Commission to approve charitable contributions to any person or <br /> entity; and <br /> WHEREAS, the City Commission wishes to codify the requirement that charitable <br /> contributions by the City must be approved by the City Commission. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISISON OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing " WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part of this ordinance <br /> upon adoption hereof. <br /> Section 2. Amendment. Chapter 172 of the Code of Ordinances of the City of Sunny Isles <br /> Beach is hereby amended to include Article II to read as follows: <br /> Article II Charitable Donations <br /> §172-4 <br /> A. Financial Donations. Cash donations to charitable organizations must be approved rov <br /> ed by <br /> the affirmative votes of at least four (4) members of the City Commission at a public <br /> meeting. <br /> B. In-Kind services and Use of Facilities.
