ORDINANCE NO. 2015 - 44 <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 62 OF THE <br /> CODE OF ORDINANCES TO CLARIFY THAT CONTRACTS FOR <br /> PROFESSIONAL SERVICES GOVERNED BY FLORIDA STATUTES <br /> §287.055 (THE "CONSULTANTS COMPETITIVE NEGOTATIONS ACT") <br /> SHALL NOT EXCEED S25,000.00 UNLESS APPROVED BY THE CITY <br /> COMMISSION; PROVIDING FOR SEVERABILITY; PROVIDING FOR <br /> INCLUSION IN THE CODE; PROVIDING FOR REPEAL OF <br /> CONFLICTING PROVISIONS; AND PROVIDING FOR AN EFFECTIVE <br /> DATE. <br /> WHEREAS, the purpose of Chapter 62 of the Code of Ordinances of the City of Sunny <br /> Isles Beach (the "Procurement Code") is to ensure compliance with applicable law regarding the <br /> procurement of supplies and services on behalf of the City; and <br /> WHEREAS, Chapter 62 requires the City Commission to approve all purchases of, or <br /> contracts for, materials, supplies, equipment, public improvements or services where the total <br /> amount to be expended is more than twenty five thousand dollars ($25,000.00); and <br /> WHEREAS, Chapter 62 also requires that purchases in excess of$25,000.00 must also <br /> follow the City's competitive bidding procedures, unless a specific exemption exists; and <br /> WHEREAS, Section 62-13 currently provides that contracts for professional services are <br /> exempt from competitive bidding, except for those contracts of more than Ten Thousand Dollars <br /> ($10,000.00) for professional services governed by Florida Statutes § 287.055 (the "Consultants <br /> Competitive Negotiations Act"); and <br /> WHEREAS, the City Commission desires to amend Section 62-13 to conform to the new <br /> threshold amount of Twenty Five Thousand Dollars ($25,000.00) for approval by the City <br /> Commission. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof. <br /> Section 2.
