ORDINANCE NO. 2015 - q Lq <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER <br /> 265 "ZONING" SECTION 265-35D(4)(C) TO PROVIDE AN <br /> OPTION FOR DESIGN FLEXIBILITY FOR LOTS WITH <br /> FRONTAGE 200 FEET OR MORE IN WIDTH; PROVIDING FOR <br /> SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; <br /> PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; <br /> AND PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of this Ordinance is to promote the public health, safety and <br /> welfare of the residents of the City of Sunny Isles Beach in the use and development standards for <br /> multi-family and hotel uses within the City which from time to time need to be clarified and <br /> adjusted; and <br /> WHEREAS. the City desires to provide options for design flexibility in side yard setbacks, <br /> for lots that may range 200 feet or more in frontage, in the Mixed Use — Resort (MU-R) District <br /> in order to treat similarly situated properties in the same manner; and <br /> WHEREAS, the City has determined that in order to be allowed to opt for such design <br /> flexibility, the owner should provide support for the maintenance of adjacent beach access, parks, <br /> or streetscape improvements; and <br /> WHEREAS, the City Commission, acting as the City Local Planning Agency, pursuant to <br /> Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed <br /> amendments to the City land development regulations. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof. <br /> Section 2. Amendment. Chapter 265, "Zoning", Section 265-35(D)(4)(c) is amended to read <br /> as follows: <br /> § 265-35. - Mixed Use - Resort District (MU-R). <br /> D.
