ORDINANCE NO. 2015 - y5L/ <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 233 <br /> ("SPECIAL EVENTS") OF THE CODE OF ORDINANCES TO CLARIFY <br /> THAT A CONDOMINIUM MAY HOLD SPECIAL EVENTS FOR GUESTS <br /> AND INVITEES UP TO FOUR TIMES PER YEAR; PROVIDING FOR <br /> SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; <br /> PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of Chapter 233 ("Special Events") of the Code of Ordinances of <br /> the City of Sunny Isles Beach ("City Code") is to provide for regulations for special events held <br /> in the City; and <br /> WHEREAS, Section 233-1 of the City Code requires the issuance of a special event permit <br /> for any organized event that takes place on public or private property, where such event would not <br /> normally be allowed based on zoning, certificate of use or business license; and <br /> WHEREAS, the City desires to amend Section 233-1 of the City Code to provide that, <br /> notwithstanding the foregoing, a condominium association may hold special events for guests and <br /> invitees up to four times per year, provided that the condominium association obtains the necessary <br /> permits under this section. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof. <br /> Section 2. Amendment. Chapter 233 of the City Code is amended to read as follows: <br /> §233-1.—Permit required. <br /> It shall be unlawful to engage in special events, defined as any organized event that takes place on <br /> public property, or private property, where such event would not normally be allowed based on <br /> zoning, certificate of use or business license, without a special events permit. Notwithstanding the <br /> foregoing. a condominium association may hold special events for guests and invitees up to 4 <br /> (four) times per year, provided that the condominium association obtains the necessary permits <br /> under this Section. However. the City reserves the right to revoke a special event permit issued to <br /> a condominium association under this Section if the special event poses a threat to the health. <br /> safety or welfare of the condominium association. including its guests and invitees.
