ORDINANCE NO. 2015 -145(,0 <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 172 <br /> ("HUMAN RELATIONS") OF THE CODE OF ORDINANCES TO <br /> PROHIBIT DISCRIMINATION AGAINST PERSONS BASED ON <br /> GENDER IDENTITY OR GENDER EXPRESSION; PROVIDING FOR <br /> SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; <br /> PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of Chapter 172 ("Human Relations") of the Code of Ordinances <br /> of the City of Sunny Isles Beach is to recognize the changing needs of society and to treat all <br /> persons fairly and equitably; and <br /> WHEREAS, the City Commission recognizes the importance of providing equal <br /> protection to persons which includes gender identity and gender expression; and <br /> WHEREAS, there are very few legal non-discrimination protections afforded to persons <br /> based on gender identity or gender expression under federal or state law; and <br /> WHEREAS, notwithstanding this lack of inclusion in anti-discrimination laws, there are <br /> currently over twenty five (25) Florida counties and cities, including Miami-Dade County and <br /> Miami Beach, that extend legal protections to persons based on gender identity or gender <br /> expression; and <br /> WHEREAS,the City Commission wishes to strengthen its anti-discrimination protections <br /> to prohibit discrimination against persons based on gender identity or gender expression. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby <br /> ratified and confirmed as being true and correct and are hereby made a specific part of this <br /> Ordinance upon additions hereof. <br /> Section 2. Amendment. Chapter 172 of the City Code is amended to read as follows: <br /> § 172-2. —Definitions. <br /> For the purpose of this article: <br /> C. Discrimination shall mean any difference. distinction or preference in treatment. access <br /> or impact against any person based on their gender identity or gender expression. <br /> D. Gender identity shall mean a person's innate. deeply felt psychological identification as <br /> a man. woman or some other tender. which may or may not correspond to the sex <br /> assigned to them at birth (e.e. the sex listed on their birth certificate). <br /> Words added underlined,words stricken deleted(ed) Page I of 3 <br />
