ORDINANCE NO. 2015 - y 58 <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br /> SECTION 265-5 OF THE CITY CODE ENTITLED <br /> "DEFINITIONS" TO CLARIFY THE MEANING OF <br /> HEIGHT ; PROVIDING FOR SEVERABILITY; PROVIDING <br /> FOR REPEAL OF CONFLICTING PROVISIONS; <br /> PROVIDING FOR INCLUSION IN THE CODE; AND <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, Section 265-5 of the City Code provides for definitions that are used to <br /> interpret the Land Development Regulations; and <br /> WHEREAS, the City Commission wishes to clarify the term height to ensure that <br /> mechanical equipment on a roof is within the maximum height limits. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby <br /> ratified and confirmed as being true and correct and are hereby made a specific part of this <br /> Ordinance upon additions hereof. <br /> Section 2. Amendment. Section 265-5 of the City Code entitled "Definitions" is amended to <br /> read as follows: <br /> § 265-5. - Definitions. <br /> HEIGHT—The vertical distance from the crown of the adjacent road to the highest point <br /> of the structure being measured, inclusive of all structures and equipment, or to the roof <br /> -- - - - <br /> . . . - : .: . In addition: chimneys shall be permitted to extend three <br /> feet above the highest point of the roof where it passes through the roof or three feet above <br /> the roof if the roof is flat; parapet walls and railings constructed on buildings with flat roofs <br /> shall be permitted to extend not higher than forty-two inches three feet above the roof; <br /> steeples shall be permitted to extend above the roof, not higher than forty-two inches. <br /> Section 3. Severability. The provisions of this Ordinance are declared to be severable and if <br /> any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br /> or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, <br /> Words added underlined,words stricken deleted(ed) Page 1 of 2 <br />
