RESOLUTION NO. 2016-2535 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, APPROVING ARTWORK IN <br /> ACCORDANCE WITH RESOLUTION NO. 14-Z-148 FOR THE <br /> MARRIOTT PROJECT LOCATED AT 17700 COLLINS AVENUE;. <br /> PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO <br /> DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br /> RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, pursuant to Section 104 of the City Code, all private development projects <br /> shall contain an artwork component on site or contribute to the City's art funds; and <br /> WHEREAS, pursuant to Resolution No. 14-Z-148, adopted on November 20, 2014, the <br /> City Commission approved the Marriott Project with the condition that the developer complies <br /> with Section 104 of the City Code; and <br /> WHEREAS,the developer of the Marriot Project has provided the required deposit amount <br /> of$34,000 for the artwork component to comply with Section 104 of the City Code; and <br /> WHEREAS, in lieu of providing further monetary contribution the Project's developer is <br /> providing an artwork component for the Marriott Project, attached hereto as Exhibit "A"; and <br /> WHEREAS, the City Commission wishes to approve the artwork component for the <br /> Project. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are <br /> incorporated herein by reference as if they are fully set forth herein. <br /> Section 2. Approval of Artwork. Pursuant to Section 104 of the City Code, the City <br /> Commission hereby approved the artwork component for the Marriott Project located at 17700 <br /> Collins Avenue, attached hereto as Exhibit "A". <br /> Section 3. Authority of the City Manager. The City Manager is hereby authorized to do all <br /> things necessary to effectuate this Resolution. <br /> Section 4. Effective Date.
