<br />ORDINANCE NO. 98 -~ <br /> <br />AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, PROVIDING FOR THE ISSUANCE OF SOLID <br />WASTE COLLECTION FRANCHISES; REQUIRING <br />FRANCHISE FOR SOLID WASTE COLLECTIONS; <br />IMPOSING FRANCHISE FEE FOR SOLID WASTE <br />COLLECTION ACTIVITIES; AWARDING FRANCHISES TO <br />CERTAIN PERMITTED PRIVATE HAULERS; PROVIDING <br />FOR SEVERABILITY, PENALTY AND AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of Sunny Isles Beach (the "City") has the authority to require persons <br /> <br />and entities engaging in the business of the collection of solid waste in the City to obtain a franchise <br /> <br />from the City and to pay solid waste collection franchise fees imposed by the City; and <br /> <br />WHEREAS, the City Commission desires to issue such franchises and to impose such <br /> <br />franchise fees, as a percentage of gross receipts, as set forth in this Ordinance. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> <br />OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: <br /> <br />Section 1. <br /> <br />The City of Sunny Isles Beach Solid Waste Franchise Ordinance is hereby created <br /> <br />to read as follows: <br /> <br />Section 1.01. <br /> <br />Definitions. <br /> <br />The following words and phrases, when used in this Ordinance, shall have the <br />meanings ascribed to them in this section. <br /> <br />(a) Commercial Establishment: Any structure used or constructed for use for <br />business operatio~. For purposes of this Ordinance, hotels and motels are <br />commercial establishments. The term "commercial establishment" shall not include <br />any single family or duplex residential unit serviced by Miami-Dade County. <br /> <br />(b) Customer: A person or business who uses the solid waste or recycling <br />services of a Private Hauler. <br /> <br />Solid Waste Franchise Ordinance (revd) <br />
