<br />ORDINANCE NO. 99- c,,'l <br /> <br />AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AMENDING ORDINANCES 98-18 AND 98-26, <br />ESTABLISHING INTERIM PARKS AND RECREATION <br />IMPACT FEE SCHEDULES; TO REPEAL THE 7 1/2% <br />GENERAL ADMINISTRATIVE CHARGE FOR THE <br />PROCESSING OF MA TERIALS RELA TING TO <br />IMPROVEMENTS AT A LOCAL PARK; PROVIDING FOR <br />APPUCABILITY; PROVIDING FOR A REPEAL OF <br />CONFLICTING PROVISIONS; PROVIDING FOR <br />SEVERABILITY AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, on January 22, 1998, by Ordinance No. 98-18, the City established an interim <br />parks and recreational impact fee schedule as later amended by Ordinance No. 98-26, which adopted <br />the Miami-Dade County's amended fee schedule; and <br /> <br />WHEREAS, the City has learned that Miami-Dade County in their fee schedule included the <br />non-refundable, general administrative charge in the amount of7 1/2% for processing of all materials <br />relating to improvements at a local park and therefore the Sunny Isles Beach Ordinance inadvertently <br />imposes a duplicative fee; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Amendment of Ordinances 98-18 and 98-26. Ordinances 98-18 and 98-26 are hereby <br />amended to delete the imposition of a non-refundable general administrative charge in the amount of <br />7 1/2% for processing of all materials relating to improvements at a local park. <br /> <br />Section 2. Applicability. Except as otherwise provided herein, all other provisions of Ordinance <br />98-18 and 98-26 shall remain in full force and effect unless otherwise modified or replaced by the City <br />Commission. <br /> <br />Section 3. Rq>eal of Conflicting Provisions. Any provision of Ordinance No. 98-18 and 98-26 <br />of the City of Sunny Isles Beach in conflict with the provisions of this Ordinance is hereby repealed. <br /> <br />Section 4. Severability. Ifany section, subsection, clause or provision of this Ordinance is <br />declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be <br />affected by such invalidity. <br /> <br />Impact Foes Amoadmoat 0rcI. <br /> <br />-1- <br />
