<br />ORDINANCE NO. 99- 1'~ <br /> <br />AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, ADOPTING A NEW CODE SECTION ENTITLED <br />FLOOD DAMAGE PREVENTION; PROVIDING <br />STATUTORY AUTHORIZATION, FINDINGS OF FACT, <br />PURPOSE AND OBJECTIVES; PROVIDING FOR <br />DEFINITIONS; PROVIDING FOR GENERAL PROVISIONS; <br />PROVIDING FOR ADMINISTRATION; PROVIDING FOR <br />FLOOD HAZARDS REDUCTION; PROVIDING FOR <br />VARIANCE PROCEDURES; PROVIDING FOR <br />SEVERABILITY, INCLUSION IN THE CODE AND AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the Federal government has certain requirements to be adopted by <br />municipalities in an attempt to prevent flood damage; and <br /> <br />WHEREAS, the City of Sunny Isles Beach deems it in the best interest of its citizens to <br />adopt an ordinance pertaining to flood damage prevention; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. The Code of Ordinances of the City of Sunny Isles Beach is hereby amended by <br />adding a new section entitled "FLOOD DAMAGE PREVENTION" which shall read as follows: <br /> <br />ARTICLE I. <br /> <br />STATUTORY AUTHORIZATION. FINDINGS OF FACT. PURPOSE AND OBJECTIVES. <br /> <br />Section A. <br /> <br />STATUTORY AUTHORIZATION. <br /> <br />The Legislature of the State of Florida has in Florida Statutes (Chapters 166 and 163) <br />delegated to local governmental units, including the City of Sunny Isles Beach, the <br />responsibility of adopting ordinances which are designed to promote the public health, safe <br />and general welfare of its citizenry. <br /> <br />Section B. <br /> <br />FINDINGS OF FACT. <br /> <br />(1) The City of Sunny Isles Beach acknowledges that there exist flood hazard areas <br />within the City of Sunny Isles Beach which are subject to periodic inundation which can <br />result in loss of life and property, health and safety hazards, disruption of commerce and <br />governmental services, extraordinary public expenditures for flood protection and relief and <br /> <br />Flood Damage Prevention <br /> <br />-1- <br />
