<br />ORDINANCE NO. 2003-J.kl:J <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AMENDING ORDINANCE NO. 99-75, AND <br />ORDINANCE NO.: 2001-142 ENTITLED "FLOOD DAMAGE <br />PREVENTION-; PROVIDING FOR AMENDMENT OF DEFINITIONS, <br />GENERAL PROVISIONS AND ADMINISTRATION; AMENDING <br />CONDITIONS FOR VARIANCES; PROVIDING FOR SEVERABILITY, <br />PROVDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE <br />CODE AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, the Federal government has certain requirements to be adopted by <br />municipalities in an attempt to prevent flood damage; and <br /> <br />WHEREAS, the City of Sunny Isles Beach, on July 15,1999, adopted Ordinance No. 99-75, <br />and on November 13,2001, adopted Ordinance No.2001-142, its Flood Damage Prevention for the <br />health, welfare and safety of its citizens; and <br /> <br />WHEREAS, the Federal Emergency Management Agency ("FEMA") has identified the <br />City of Sunny Isles Beach as lying within a special flood hazard area; and <br /> <br />WHEREAS, the City wishes to adopt this amendment to the flood damage prevention <br />ordinance, in accordance with FEMA requirements and for the special benefit, health, welfare and <br />safety of its citizens; <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. The Code of Ordinances of the City of Sunny Isles Beach is hereby amending <br />Ordinance No. 99-75, and Ordinance No. 2001.142 "FLOOD DAMAGE PREVENTION" which <br />shall read as follows: <br /> <br />ARTICLE I. <br /> <br />STATUTORY AUTHORIZATION. FINDINGS OF FACT. PURPOSE AND OBJECTIVES. <br /> <br />Section A. <br /> <br />STATUTORY AUTHORIZATION. <br /> <br />The Legislature of the State of Florida has in Florida Statutes (Chapters 166 and 163) delegated to <br />local governmental units, including the City of Sunny Isles Beach, the responsibility of adopting <br />ordinances which are designed to promote the public health, safe and general welfare of its citizenry. <br /> <br />Flood Damage Prevention Ord. <br />Legislation/Ordinances/Attorney <br />4/7/03 --5:04 PM <br />
