<br />ORDINANCE NO. 2005-222 <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-46 <br />"OFF-STREET PARKING, LOADING AND DRIVEWAY <br />STANDARDS" OF THE LAND DEVELOPMENT REGULATIONS TO <br />REPEAL SECTION 265-46A (2) (b) WHICH PROVIDED FOR A <br />PARKING "BUY-DOWN" AMENDING SECTION 265-46A(4) TO <br />REDUCE TANDEM PARKING FROM 100% TO 20%; AMENDING <br />SECTION 265-46A(7) TO ENLARGE THE SIZE OF ALL PARKING <br />SPACES TO NO LESS THAN NINE FEET; PROVIDING FOR <br />INCLUSION IN THE CODE; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission has the authority to amend its Land Development <br />Regulations; <br /> <br />WHEREAS, the City Commission has reason to believe based on demographic trends as <br />well as the significant increase in light of the use of trucks, vans, and sports utility vehicles for <br />daily transportation that current parking requirements for the City must be revisited to address <br />both the number of parking spaces as well as the space dimensions to accommodate vehicle size. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA AS FOLLOWS: <br /> <br />Section 1. <br /> <br />Amendments. <br /> <br />a. Section 265-46A.(2)(b) "Off-Street Parking, Loading and Driveway Standards" <br />of the Land Development Regulations of the City of Sunny Isles Beach, Florida <br />providing up to 20% of the off-street parking spaces to be bought down by a <br />contribution to the City Off-Street Parking Trust Fund be and the same is hereby <br />repealed. <br /> <br />b. Section 265-46A (4) Tandem parking. Tandem parking shall abide by the <br />definition under Article II of this Code. Twenty (20) percent of the required off- <br />street parking spaces, other than handicapped parking, may be permitted as <br />tandem parking. Tandem parking spaces shall meet the dimensional requirements <br />of the code for standard parking spaces; the drive aisles may be reduced to 18 <br />feet. All applications for the use of tandem parking must be approved by the City <br />Commission and the applicant must enter into an agreement, recorded in the <br />public records at the expense of the owner and shall run with the land and shall <br />bind the heirs, successors, and assigns of said owner which requires all <br /> <br />02005-222 Amd On-Street Parking See 265-46.Doc <br /> <br />Page 1 DB <br />
