<br />ORDINANCE NO. 2005-~ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION <br />33-3(E) (4) OF THE ETHICS CODE OF THE CITY OF SUNNY <br />ISLES BEACH TO REQUIRE DISCLOSURE OF ANY GIFT <br />HAVING A VALUE IN EXCESS OF ONE-HUNDRED (($100) <br />DOLLARS; PROVIDING FOR SEVERABILITY; PROVIDING <br />FOR REPEALER; PROVIDING FOR INCLUSION IN THE <br />CODE; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City is required to comply with the Ethics Code of Miami-Dade County; <br /> <br />and <br /> <br />WHEREAS, the Miami-Dade Commission on Ethics has recently amended its Gift Law <br />to increase the disclosure amount for gifts from twenty-five ($25) to one-hundred ($100); and <br /> <br />WHEREAS, the City wishes to amend its Ethics Code to comply with the Ethics Code of <br />Miami-Dade County; and <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, AS FOLLOWS: <br /> <br />Section 1. <br />follow: <br /> <br />Definitions. Section 33-3(E)(4) of the Ethics Code is hereby amended to read as <br /> <br />(4) Disclosure. Any person included in the terms defined as <br />COMMISSIONERS; AUTONOMOUS PERSONNEL; QUASI- <br />JUDICIAL PERSONNEL; ADVISORY PERSONNEL; <br />DEPARTMENTAL PERSONNEL; and EMPLOYEES in <br />subsection B shall disclose any gift, or series of gifts from anyone <br />person or entitv, having a value in excess of one-hundred dollars <br />($100.00), Said disclosure shall be made by filing a COpy of the <br />disclosure form required by Chapter 112., Florida Statutes, for <br />"local officers" with the City Clerk simultaneously with the filling <br />of the form with the Secretary of State. <br /> <br />Section 2. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held to be <br />invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clauses, and phrases of this Ordinance but shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> <br />Gift Amendment Ordinance. <br />Created on 2/2/05 <br /> <br />1 <br />
