<br />ORDINANCE NO. 2006-.2::L{P <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, ESTABLISHING DISTANCE REQUIREMENTS <br />FOR ALCOHOLIC BEVERAGE ESTABLISHMENTS; PROVIDING FOR <br />PURPOSE AND INTENT; PROVIDING FOR DEFINITIONS; PROVIDING <br />FOR EXCEPTIONS FROM DISTANCE REQUIREMENTS; ESTABLISHING <br />LICENSE REQUIREMENTS; ESTABLISHING HOURS OF OPERATIONS; <br />PROVIDING FOR ISSUANCE OF CONDITIONAL USE PERMITS BY THE <br />CITY COMMISSION; PROVIDING FOR PENALTIES; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR A REPEALER; PROVIDING FOR <br />INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission recognizes that the Miami-Dade County code prOVISIOns <br />regulating alcoholic beverage establishments are intended to be general in nature and do not address the <br />specific requirements of the City of Sunny Isles Beach; and <br /> <br />WHEREAS, the City Commission wishes to regulate the location of alcoholic beverage <br />establishments within its jurisdictional limits; and <br /> <br />WHEREAS, the City Commission wishes to adopt this Ordinance to protect the public safety <br />and welfare. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. IncorDoration of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are made a specific part of this ordinance by reference as <br />if fully set forth herein. <br /> <br />Section 2. Purpose and Intent. The City Commission of the City of Sunny Isles Beach finds, <br />determines and declares that it is in the best interests of the health, safety and welfare of the City and <br />its residents and visitors that it enact the following regulations governing the location of alcoholic <br />beverage establishments within the City. The purpose of this Ordinance is to provide uniform <br />operational regulations for all establishments in the City dealing directly or indirectly with the sale of <br />consumption of alcoholic beverages. <br /> <br />Section 3. Definitions. The following words, terms and phrases, when used in this article, shall <br />have the following meanings. <br /> <br />(a) Alcoholic beverage means a distilled spirit and any beverage containing one-half of one <br />percent or more alcohol by volume. The percentage of alcohol by volume shall be determined by <br />measuring the volume of the standard ethyl alcohol in the beverage and comparing it with the volume <br />of the remainder of the ingredients as though said remainder ingredients were distilled water. It shall <br />be prima facie evidence that a beverage is an alcoholic beverage if there is proof that the beverage in <br />question was or is known as whiskey, moonshine whiskey, shine, rum, gin, tequila" vodka, scotch, <br />scotch whiskey, brandy, beer, malt liquor, wine, wine cooler, or by any similar name or names, or was <br />contained in a bottle or can labeled as any of the above names or a name similar thereto, and the bottle <br /> <br />02006.246 Alcoholic Beverages Ordinance <br /> <br />Page I of7 <br />
