ORDINANCE NO. 2007-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTIONS 265-51, 265-56, AND 265-57 OF THE SIGN CODE; ESTABLISHING NEW REQUIREMENTS FOR WINDOW AND TEMPORARY SIGNS; ESTABLISHING NEW REQUIREMENTS FOR APPROVAL OF MURALS AND GRAPHICS FOR TEMPORARY CONSTRUCTION FENCE; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has a desire to protect the public safety and welfare and promote positive conditions for sign communication to enable business identification while eliminating visual clutter in the City; and WHEREAS, the City Commission wishes to amend the sign code to address certain issues relating to window and temporary signs. NOW THEREFORE, BE IT ORDAINED BY TIlE CITY COMMISSION OF TIlE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses arc hercby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 265-5 I of the Sign Code is amended to read as follows: ~ 265-51. Definitions. WINDOW SIGN m_ A sign attached to or painted on the inside of a storefront window or door or anv sign located within a window or upon the inside surface or outside surface of the window glass used to attract such attention located within the premises which is located within three (3) feet from the window opening.
