<br />ORDINANCE NO. 2007 - ?. ~ t.\ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER <br />193 OF THE SUNNY ISLES BEACH CODE OF ORDINANCES <br />ENTITLED "NOISE" BY ESTABLISHING REGULATIONS <br />RELATING TO VARIOUS TYPES OF NOISE; PROVIDING FOR <br />REPEAL, SEVERABILITY, CODIFICATION AND AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission recognizes that property owners are entitled to the <br />safe, quiet and comfortable enjoyment of their home and business, and finds that certain types of <br />noise infringe on the public's health, safety, comfort and repose; and <br /> <br />WHEREAS, the City Commission desires to establish guidelines that regulate various <br />types of noise within the City of Sunny Isles Beach; and <br /> <br />WHEREAS, the City Commission further finds that creating these regulations is in the <br />best interest of the City residents. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section I. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this ordinance <br />upon adoption hereof. <br /> <br />Section 2. Amendment. Chapter 193 of the Sunny Isles Beach Code entitled "Noise" is <br />amended to read as follows: <br /> <br />193-1. Purposc and intcnt. <br /> <br />The purpose of this chapter is to limit excessive eOHstruction noise that interferes with the <br />comfOliable enjoyment of life, property, recreation or conduct of business in the City. <br /> <br />193-2. Definitions. <br /> <br />The following words, terms and phrases when used in this chapter shall have the meaning <br />ascribed to them in this section, except where the context clearly indicates a different meaning: <br /> <br />CITY MANAGER - The City Manager of the City of Sunny Isles Beach or designee. <br /> <br />CONSTRUCTION - Any site preparation, assemble, erection, substantial repair, alteration, <br />demolition, or similar action, or public or private rights-of-way, structures, utilities or property. <br /> <br />CONSTRUCTION TOOLS AND EQUIPMENT - Includes but is not limited to: material <br />handling, eartiunoving and digging equipment, power tools, generators, air compressors, hand <br /> <br />U:\LEGISTLATION\Draft Ordinflnces\2007\Amending Chapler 193, Noise 030207 CLEAN.doc <br />
