<br />- <br /> <br />ORDINANCE NO. 2010-$ <br /> <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER <br />256 OF THE CODE OF ORDINANCES OF THE CITY OF <br />SUNNY ISLES BEACH TO INCLUDE BICYCLE RULES AND <br />REGULATIONS; PROVIDING FOR PENALTIES AND <br />ENFORCEMENT; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR INCLUSION IN THE CODE; PROVIDING <br />FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of the City of Sunny Isles Beach ("City <br />Commission") desires to encourage safe and efficient bicycle travel in the City of Sunny Isles <br />Beach ("City"); and <br /> <br />WHEREAS, the City Commission wishes to incorporate bicycle rules and regulations, <br />consistent with the laws of the State of Florida and Miami Dade County, to help instill safe <br />bicycling habits in the City; and <br /> <br />WHEREAS, the City Commission desires to amend Chapter 256 of the Code of <br />Ordinances of the City of Sunny Isles Beach ("Vehicles and Traffic") to effectuate safe bicycle <br />rules and regulations in City. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br /> <br />I · <br /> <br />Section 2. Amendment. Chapter 256 of the Code of Ordinances of the City of Sunny Isles <br />Beach ("Vehicles and Traffic") is amended to read as follows: <br /> <br />ARTICLE V. <br /> <br />~ 256-37. Bicycle rules and regulations. <br /> <br />(1) A bicycle is defined as every vehicle propelled solely by human power, and every <br />motorized bicycle propelled by a combination of human power and an electric <br />helper motor capable of propelling the vehicle at a speed of not more than 20 <br />miles per hour on level ground upon which any person may ride, having two <br />tandem wheels, and including any device generally recognized as a bicycle <br />though equipped with two front or two rear wheels.
