<br />RESOLUTION NO. 2012-~Z. <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, TERMINATING THE <br />DECLARATION OF RESTRICTIONS ISSUED PURSUANT TO <br />RESOLUTION NO. 05-Z-99; AUTHORIZING THE CITY <br />ATTORNEY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, by Resolution No. 05-Z-99, adopted on December 8, 2005 the City <br />Commission approved a development project known as the Da Vinci condominiums; and <br /> <br />WHEREAS, a Declaration of Restrictions was filed in the property records of Miami- <br />Dade County pursuant to Resolution No. 05-Z-99; and <br /> <br />WHEREAS, the City Commission wishes to terminate the Declaration of Restrictions <br />due to the fact that the zoning approval has expired. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> <br />Section 1. Termination of Declaration of Restrictions. The City Commission hereby <br />terminates the Declaration of Restrictions issued pursuant to Resolution No. 05-Z-99 for the <br />Da Vinci project. <br /> <br />Section 2. Authorization of the City Attorney. The City Attorney is hereby authorized to do <br />all things necessary to effectuate the terms of this resolution. <br /> <br />Section 3. <br /> <br />Effective Date.
