ORDINANCE NO. 2017- S i3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 14-3 OF THE CITY CODE OF ORDINANCES TO ADJUST THE COMPENSATION FOR CODE ENFORCEMENT MAGISTRATES; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CITY CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 14 of the Code of Ordinance of the City of Sunny Isles Beach pertains to "Code Enforcement"; and WHEREAS,the intent of Chapter 14-3 is to regulate the code enforcement hearing process through the use of a Special Magistrate; and WHEREAS, the City Commission wishes to increase the compensation rate for Special Magistrates, commensurate with the current market price. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 14-3 of the City Code is hereby amended to read as follows: § 14-3. - Qualifications of Special Magistrates; appointment and removal; compensation. C. Special Magistrates shall not be City employees and shall be compensated at a rate not to exceed $150.00 per hour with a two hour $500.00 minimum per hearing date, which fee shall include case preparation, execution of final orders and attendance at all hearings, including appeals, if necessary. Section 3. Repealer. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance, but shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
