ORDINANCE NO. 2017- S i3 <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING <br /> SECTION 14-3 OF THE CITY CODE OF ORDINANCES TO <br /> ADJUST THE COMPENSATION FOR CODE <br /> ENFORCEMENT MAGISTRATES; PROVIDING FOR <br /> REPEALER; PROVIDING FOR SEVERABILITY; <br /> PROVIDING FOR INCLUSION IN THE CITY CODE; <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, Chapter 14 of the Code of Ordinance of the City of Sunny Isles Beach <br /> pertains to "Code Enforcement"; and <br /> WHEREAS,the intent of Chapter 14-3 is to regulate the code enforcement hearing process <br /> through the use of a Special Magistrate; and <br /> WHEREAS, the City Commission wishes to increase the compensation rate for Special <br /> Magistrates, commensurate with the current market price. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon <br /> adoption hereof. <br /> Section 2. Amendment. Chapter 14-3 of the City Code is hereby amended to read as follows: <br /> § 14-3. - Qualifications of Special Magistrates; appointment and removal; compensation. <br /> C. Special Magistrates shall not be City employees and shall be compensated at a rate not <br /> to exceed $150.00 per hour with a two hour $500.00 minimum per hearing date, which <br /> fee shall include case preparation, execution of final orders and attendance at all hearings, <br /> including appeals, if necessary. <br /> Section 3. Repealer. All ordinances or parts of ordinances in conflict herewith be and the <br /> same are hereby repealed. <br /> Section 4. Severability. The provisions of this Ordinance are declared to be severable and if <br /> any section, sentence, clause or phrase of this Ordinance shall, for any reason, be held to be invalid <br /> or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, <br /> clauses, and phrases of this Ordinance, but shall remain in effect, it being the legislative intent that <br /> this Ordinance shall stand notwithstanding the invalidity of any part. <br />
